Question, I put down a deposit for a 07 mini S and i've already received the production number for about 5 days now. If i wante to, could i get my money back and back out of the sale? or is it too late?

I'm sure in most cases the deposit is refundable. A good idea is to make sure before you place that deposit.
Before I placed my order, my made sure with my MA about the deposit. I asked him if I can get my deposit back in case I lost my job, or suffer a injury where I can't drive a stick shift anymore etc...

Are you sure that you didnt get your years crossed... and you ordered an 05 and want to change it for an 07

I had a similar dilemma . I was originally looking for a 2004 MC40, once I found the one I wanted, It got sold under the morning I went to buy it. I then moved to looking at the R56 and have not looked back.
An 05 MCS with only 24 miles? That would mean the car has been sitting on the lot for a long time. Probably not a very good thing for the engine and other parts of the car. I would be very careful about buying such a car.
You will get your deposit back as there is no purchase agreement until there is a car! I clarified this with the dealers I shopped with in the Chicago area. I also had the MA write "deposit refundable" next to the deposit line and initial it on the order form for additional piece of mind.
PS: Check the manufacture date, there were some good changes as of Jan 05 production, plus you'd want to know how long since production.
Sometimes new cars just get kinda lost and end up not getting sold - I worked with someone who bought a new/past year Audi like that and it was fine. I'd just make sure they change out/flush all the fluids, check tires for flat spots, provide the extended warranty, give a heafty discount and bonus stuff

You will love the 2007 R56. I got my MCSa Oct. 04. This past weekend I filled it up for the first time and on a drive of about 60 miles I got 38 MPG with the auto transmission. (Taking it easy of course). Also, the torque of the turbo is just a wonderful thing. I used to think that I wanted the earlier model also, when the R56 first came out. But I am very happy with the 2007 and am glad that I didn't get the R53. It will save thousands in gas over the life of the car and has all the power and torque I will ever need. And no issues with it so far.
R53 v R56, LOTS of opinions, pro and con both ways. Have to agree w/ you about the looks, but that's purely subjective. I'd rather have an '06 R53, but in any case, here's a thought: '05 will be out of warranty in another year, and then if you want go-fast mods, you're much better off. Not much of anything available besides JCW for juicing up the '07, and from what I understand, that has to be done at the factory.

The late model 2007 MINI's are pretty much identical to the 2008 model. Starting around the August builds most of the new 2008 features were added to the late build 2007 cars (many computer changes, etc.). This makes sense since the rest of the world started receiving what we yanks call the 2008 model way back in August of 2008. The only real significant changes you're going to get with a 2008 model is the USB port (assuming you order the Bluetooth Prep option), auto-up driver's side window (which is apparently now delayed even for the 08 models), and a price increase on many of the options/packages.
Thus, if you don't need the USB port, or really don't want to pay the price increases (which could be upwards of $1,000 depending upon your options), then get a 2007 while you still can. Otherwise, hold off for a December build slot and take the 2008 model instead. The cars will be identical in all respects (including their bugs).

Actually, if the car is new and untitled it should have the full new car bumper to bumper warranty, the roadside assistance, etc. They *could* even throw in an extended warranty 
As for first year bugs you never can tell when a manufacturer will make production changes that fixes issues - for instance many experienced sunroof part issues (this one bit would be prone to breaking easily), HK speaker rattles and window regulator failures on the 00 BMW E46 coupe which stayed with the car for several years of production and also appeared in the M3 that shared the platform. I do think that any major problems, like the wiring harness rubbing problem that happened on some 05 Minis will be learned off of the early buyers and get fixed along the way in the first model year production or addressed in recalls as quickly as possible. All in all though it is hard to say when 'bugs' will be fixed since they can only address problems as they become known and patterns emerge as the cars get some mileage on them in the real world. In the end it is all simply luck of the draw when it comes to car issues - just get your car and enjoy it I think
