Damn. I'm sorry that happend to your baby, you never think it's going to happen to you do you? Make sure the adjuster knows about the nick in the wheel or it will get ignored.

That really sucks....
A brand new car is ruined by someone else's fault.
If it was mine, I would wish that it was totaled. No, the insurance doesn't pay for the depreciation. It just sucks to be a victim.

Repair work doesn not necessarily mean "filler" and it certainly does not mean "Bondo".

Get with the times, man... this is not the 80's anymore !!

NONE of it applies in MA ?

So, in MA the insurance companies CAN make you take your car to one of the shops on their program ??

Shops outside the insurance company's program don't guarantee their work ?

I work in four jurisdictions... DE, MD, DC, and WV... glad I don't have to work in MA !

The way it was explained to me is that the shops that are approved are guaranteed by the insurance company, and will work at the approved rate set by my insurance. I can bring my car anywhere, but I have to pay the difference between what the shop wants and what my insurance will pay. That being said, I had my car towed to the collision center of a large area dealer, who has agreed to work at the rate set by my insurance. And they certainly guarentee their own work.

well, I just found out that the initial assessment of damages to my car was $2,903.74. Of course, I'll be getting a check for $2,403.74 while the two insurance companies determine who is at fault. I'm sure she will pay my $500 deductable too. Because if she doesn't...

Meanwhile I'm cruising around in a late model lexus es300 w/ 155k on the o.d., torn-up seats, and no display for the radio. I had forgotten how quick my MINI was compared to other cars. Oh well, hopefully we'll be reunited soon. Then I'm thinking about getting a push-bar bumper like you see on cruisers. That'd be bad@$$...

Did your insurance company tell you why the other company hasn't yet accepted liability ? If their driver has somehow concocted a story of how the accident happened (like you rear-ended her, since the damages to both vehicles would make that a plausible senario), it may be a word vs word situation unless you have any witnesses.

Hope that's not the case !! Hope it's simply a matter of them getting their insured to return their calls or something of that nature.

I think we should all look into a class action law suit. The pain and suffering from seeing a hurt Mini was more then I could bear. How about y'all?

I sure hope her company pays. I had a car back into the side of mine once, no police were called at the time (mistake). He concocted some story for his Allstate agent how I somehow slid sideways into the back of his car (??) and they refused to pay to fix mine. I raised hell, they refused to tell me what he reported. They didn't care what I reported at all. Luckily my friend's dad was VP of the company and when I complained to him Allstate paid for my repairs (and cancelled the liars car insurance). I hope you get what you deserve. It tought me that after the accident the person may change their story to prevent their rates from going up.
