BGWC, you are right to be upset. There are criteria for fair use of copyright material, and this clearly violates them (he is using a photo to which he does not own the rights for his own profit). There are serious fines for this if you want to pursue it.
In terms of the fraud part, did you contact the shop that did your stripes? They may have grounds for a suit or settlement (over and above whatever ebay does to the seller).

If I had a Ebay account I'd bewriting them too. I've had my work pulled off NAM and used in an email advertisement without my persmission, needless to say that the vendor no longer gets any support from me (thoguh I won't slander) Fortunatley it was a one time infraction so I didn't have to rasie h#!!
I've also heard stories of magazines grabbing up photos from Bimmer forums and using them without crediting the photographer.
I usually don't care unless its something like this where its misrepresentation or using a photo to make money without giving any credit to the author.

The seller has total control over what questions and answers appear in the ad. I sell a fair amount on eBay and the standard response form has a check box for having the Q&A appear in the ad. No matter how many people write this seller, the comments will not appear in the ad unless he is foolish enough to put them there.

JJ, did you wake up in a field somewhere miles from home? Maybe you were abducted by Aliens (Australian Aliens) and then administered drugs to make you forget. I waded through e-bay...
and left comments. And asked the seller a question about where they got off on claiming someone elses product was their own. I'm sure I'm not the only one, and I'm sure the seller could read the tea leaves....

i guess i feel like the only one who wouldn't care if they use my pics for there presentation as long as its not totally misrepresentation or misleading but thats just me. as long as i dont get hurt than its fine.

But that's the whole issue - there *was* blatant misrepresentation. In his ad, the seller was trying to pass off the stripes on her car as *his* product, which they were not. Maybe his are just as nice, maybe they're crap, but you'll never know from the pictures, since their not his stripes.
It's like the companies that manufacture "kit cars" of Lamborghinis, Ferraris, Porsche Spyders, etcetera, but use pictures of the REAL CARS in their advertising. They're trying to pass off someone else's work as their own, pure and simple.
