If you are over the warranty period and this is a common problem in BMW and Mini's it could be claimed as a latent defect....worth a try. I said in another post...car companys hate to hear that line...can result in an expensive recall! Not safety related (IMHO) so NTSB is out....
OT but my 04 with 18400 mi just had a passenger side window regulator replaced under warranty. It started to squeak.

I just had my driver's side window cease working in the down position. Bumping on the door in many places did not resurect it. I have an appointment at the dealer tomorrow. I suppose I need to remove the GB MINI auto-up circuit before I take it in.......
I removed the auto-up circuit last evening. I took it to the dealer today. They were amazed as they said it was the first one they have seen with the window down when the motor crapped out. Their diagnosis said it had an open circuit in the motor. They had to cut the cable on the regulator just to get the window up to reach the winder motor, so I left with a new motor and new regulator. Was at the dealer just about one hour. Auto-up circuit will be back in tomorrow.

Good to know Paul. Had a few problems with my windows during the hottest part of the summer. No problems now though. Sounds like I may need a new regulator & motor soon. Out of warranty, so I'm going to hold off on replacement for now.
My dealer said the window motors go all the time. Can't believe yours was the first in your area, Paul. Sometimes I think denial (for fear of bad word-of-mouth on the car) is the knee jerk response from dealers.
I just had my drivers side window motor replaced at about 49,500 miles. It was intermittant. The dealer was aware of the issue.
Good tip on the salvage yards. I used to buy parts for my Jeep that way when it got older. Found the yards website, called them up, they shipped. Very easy and saved about 75%.

Yes, it's the motor.
The proper fix is a new motor - a short term repair is:
Hit the door panel, right below the handle you use to open the door, while at the same time clicking the window switch - this will jog the motor and get current flowing, so the motor turns.
It will then stay working for a while - maybe a day, maybe a month ...

Mines an May '02 with 32k miles. Out of warranty time wise.
Found this thread.
Worked like a charm.

good old searching on NAM... my warranty ran out and my passenger side window stopped working.. gave it a nice bang underneath the door handle while holding the toggle switch down.. and there it goes... now it works.. for now
