Advice please
So I am interested in a 2004 mini Cooper S , the man says it's a mc40,that it's rare, decal came off so I don't know what number it is ,so that's a con . But my question is how do I know for sure it's a mc40 ? I figured it needs to be a 2004 S with the JCW package right? Meaning exhaust and intake are different and red leather seats? And how much is it worth with 140,000 miles

The JCW package was an accessory dealer add on when the MC40 came out and a JCW MC40 is supposed to be really rare.
Without the decals and ID plate by the shifter, the more of these items the car has, the more likely it’s a real MC40: two tone red and black leather seats, JCW carbon fiber dash, dual auxiliary gauges below the toggle switches, auxiliary driving lights, MC40 shift **** and rubber floor mats, no sunroof, anthracite BBS R90 wheels, chrome mirror caps, grille, GB letters and handle on the hatch. Of course all this could be added to a regular S, but I think two of the bigger items for identification would be the seats and no sunroof.
I don’t think MC40’s can be verified by looking up the VIN build specs online, but the original selling dealer might have something in their records. From previous posts about identifying an MC40, MINI/BMW corporate doesn’t seem to have any info on the cars. If it is real, it’ll take some luck to find out the individual number with a missing ID plate. Recently a member was able find out his number from old posts on this site.

Edit: presumed you meant the VIN tag, on the door frame, will defer to others on the MC40 plate but presume that would be the last thing the PO would allow to go missing - along with all the other documentation - from a genuine car.
Assuming it is an MC40 but not a JCW and that everything else unique about the MC40 is present other than what you mentioned. I’d offer $4-5k unless it was in absolutely great condition.
