R53 manual transmission leak.

I have a 06 mini cooper s and my seal around the clutch rod, where it goes into the transmission is leaking. Dealer says that they dont list a seal there. so what am i supost to do. im a mechanic and do all my own work on my car. but if i cant find the part do they expect me to replace my entire transmission due to this leak? Has anyone have the same issue or have an idea? im not paying the dealer to look at my car to tell me the same thing. i work for a dealer and know how the business works.
This is the diagram from mini parts department. they say number 5 is a nylon bushing and it really is as the dealer showed me the part in person.

Nope. He said that he saw the Clutch Rod leaking, went to the dealer and they said there was no seal in there. Fact is, there should not be fluid behind the fork.

Are you sure you're not confusing this with a slave cylinder leak? It will cause wetness around this same area. Will be same color as brake fluid where trans fluid will be about black.

Yes i know its not the slave cylinder as that was the first thing that i checked. i wanted to make sure that it wasn't the cylinder.
