Never heard of that happening. Before it warms up, will the car drive? If so, does it shift between the gears (e.g. first to second)?

May want to call a dealership nearby and see if they have heard of the issue. Seems to be related to the cold but I live in warmer climate and haven't heard of anything like this.

A few questions need answers first. What year, which gear box (Aisin or CVT) and when was the last time the fluid was changed.
Do not take it to a dealer unless it is under warranty. Dealer's main tactic for solving problems is to just throw new parts at it rather than attempt to find the root of the problem and solve it. Ask around for a reliable independent BMW/MINI shop in your area or try http://www.tonalco.ca/pages/en/home.php right there in Montreal.

First, thanks you for the link
I have a 06 cooper s 6 speed manual with 105 k miles, dont think the fluid have been change since new, but it was already on my (spring to do list)

the only reason I can think about this problem is, the last few days it was warm (like 35-38) and we had heavy rain, lots of water on the road like 3 inches in some places, I think some water went into the cables shifter and now it freeze when stopped for hours, because when the car is warm, it shift normally as usual.
sorry for my poor english

OK then. From the initial info, it sounded like you were suffering with an automatic gear box. What you have is the Getrag, a very solid, near bullet proof gear box. Fluid is essential but not as picky as in an auto box. If you haven't had it done yet, look to having the brake system flushed and re-filled. That will also take care of the gear box. 50K miles is a good interval for that service. Lots of MINI people change oil and rotate tires at the 5K interval as well, the oil change interval being a subject fraught with opinion.
