MINI USA may not wait for your EB MINI order. Maybe you should consider trucking your car in from MINI of the Hamptons or Classic MINI. Better yet, fly over and MOTOR back to Cali. That way, your car will have been broken in, you don't pay over MSRP, and you'll have a grin from ear to ear.
Another thing you could do is check with other people who ordering their MINIs and find out the delivery date. Perhaps all of you could motor back in a group.

It's in Mentor, Ohio, just outside of Cleveland. Be sure to check the dealer reviews on them. I believe they have cars on the lot if you want something shipped asap.
For shipping, if you want to pay a little more for an enclosed truck I would recommend http://www.concourstransport.com. There are several companies out there that specialise in enclosed shipping for high dollar cars. The cost is a little more (think $1000-$1500), but I think the service is worth it.
Keep in mind a plane ticket and gas back to CA would be alot more fun and cost alot less.

I was just thinking and ordering the car out of state probably isn't an option. I doubt MINI will want to deal with paying the taxes and registration on a car shipped over to California. Which puts me back at having them buy back my car and then buying it on my own which will cost as much as paying the dealer mark up or maybe even more.

I agree. If you can swing the time, this would be a great opportunity for a road trip, either by yourself or with a friend.
If you're willing to do this, you should be able to find several dealers selling at MSRP or less with just a few phone calls. You can then decide which one gets your business based on the price or the air fare or which area of the country you'd really like to see or even a dart throw!

If i do it the MINI way they pay tax and liscense. Well I pay tax on the difference for the upgrade. I have a feeling this will be a serious problem if I but from out of state. I am almost positive they will say no or make me pay tax and reg on my own which probably puts it over the dealer mark up.

You pay tax and liscence when you register your car in your home state. When I got mine from Classic I just cut them a check for the price of the car. I may have paid $20 for a temp Ohio plate, but that was it. There were no Ohio taxes or anything.

The whole idea behind lemon law is that you get a new car to replace the current one because it is a piece of crap. Mini has to pay tax and liscense. This is totally defeating the purpose if I have to pay those fees a second time because MINI sold a car that was crap.

Bummer about MINIUSA's stubbornness. It seems as though they try in the wrong direct far to often and fail to realize happy customers are the best sales people. MINIUSA really needs to rethink their approach to "special handling".
Long Beach Mini sells at MSRP but the wait is so looooooooooong. Call them, explain what is going on with MINIUSA and go with whomever can give a priority order. I would even call Mini of Peabody since they are a stand alone dealer and are also dedicated to happy customers and happy MINIs.
One of these three dealers may well be your best ally and negotiator with MINIUSA. It never hurts to ask, and you will never know until you ask.

Sounds like you have two options in persuing your Lemon case:
1) take the offered cash settlement
OR
2) screw around with MINIUSA for a replacement that meets their satisfaction
I'm guessing the cash settlement was not acceptable. As you're finding out, MINIUSA is not exactly a breeze to work with. Does NOT paying the $2500 ADP make option #1 more appealing? Furthermore, your basis of complaint in paying taxes and registration again feels skewed to me; you'd be getting a BRAND NEW CAR. In my eyes, that's worth dishing out the few extra bucks for legal paperwork. Remember, you can always deal with your current Cooper, but it also sounds like you're itching for an S. Speaking of your Cooper, what is wrong with it?

Or do like I did, 4,551 miles later! Buy it out of state, in my case, Roadshow in Memphis, TN, and drive it back (to California)! You'll still spend $500-$1000 for a plane ticket, food and motels, but heck, it's worth it, and the satisfaction of knowing you didn't just put the money into the dealers pocket! Might take anywhere from 3 days to a week to pull it off. I did it in 11 days, but visited 12 states. Good luck!

The only regress the dealer has is to sue you in court for damages and damages can be hard to prove.
Tell the representative from BMW of North America that is handling the buy back that you are unwilling to pay a mark-up over MSRP. The distributor can exert a lot of pressure on the dealer. I would bet they can get things worked out for you.
BMW of North America gets slammed a lot on this forum but I have found they do try to do what is right. Sometimes the right hand doesn’t know what the left hand is doing but if you are persistent and patient and are willing to work with them they usually are very fair and accommodating.
