I hate to bring up a sore subject but how did Jobs get away naming his new hardware without BMW coming down on him?

I'll chime in on this since I have the most experience in this area now .

The reason is that Apple's use of the word mini is related to an audio product whereas BMW's use of the word Mini is related to automotive use. Since they are different markets they are considered NOT to be easily confused through the use of the same term.

If, however, there was a audio product called the "Mini" by another company it really comes down to who was using it first and/or has it trademarked. Apple is generally very good about trademarking there products very early in the formation of the product so I doubt that this will present a problem for them.
