Hi NFO. MCO newbie here. I'm sorry to hear about your accident. I hope everything works out for the best. I'm glad to hear the that you are in one piece and the MINI held up as well as it did.

I was in an accident not too long ago. You mentioned there was a police officer present, thats great. Hang on to the police report.
I wonder, was anyone issued a ticket? Did the other person have car insurance? If they did, contact them immediately, dont wait for the other person to contact them. Report to them what happened and that your in pain and would like to visit a doctor. They should take care of everything.
This is a long process. I have seen it take over a month with a customer of mine for thier MINI to be "totalled". Be strong, push the other insurance company to make you happy. Get a rental. If they begin to lag, go to your own insurance company, they will more than likely help you and then go after the other pesons insuarnce company for the money.

Just to emphasize some of what's been said here already, you need a good lawyer (one you can trust, ideally recommended by an equally trusted friend or family member) soon. Sadly, this has to take equal priority to the attention you also need to pay to your physical health. One of the first things that this lawyer will do is to help insure that you are not held responsible for what will no doubt be a mounting series of medical bills. Even if you have health insurance (I'm assuming you do), YOUR insurance company will likely catch on very quickly that you were rear-ended and thus will attempt to put the bills off to the other driver's insurance. Of course, their insurance will try to dodge...and you don't want to be caught in the middle of this. A lawyer can advise you and work the system to your protection. 6 months down the road, this sort of early legal intervention will be something you're very thankful for.
I speak from experience. My wife and I were in a very serious accident (we weren't driving, but were passengers in a car service) about 8 years ago. When all was said and done, our non-life-threatening injuries (despite the fact that we were still pretty banged up) cost nearly $300,000 in medical bills. Our insurance company and the insurance company of the car service battled this out for about 2 years...which was/is standard operating procedure in these matters. Only due to our excellent lawyer were we able to avoid having to have those bills paid out of our pocket while the legal wrangling went on.

Based on this story and other accident posts I've seen, I'm glad MINIs are doing well at protecting passengers. While I'll never refer to the MINI as "just a car" it is a material item and I'd rather it destroyed than a human. Let us thank the engineers who did a fine job with the safety features.

I am completely heartbroken. I can imagine how you must feel. Get to a doc ASAP. Injuries that you didnt know you incurred could creep up later. You might have a slipped disc or something. Good luck, and a speedy recovery!

all three parties involved in the accident are insured by allstate!
i don't know if that is good or bad, i guess it could be a little of both.
i've left a message for a good lawyer and i was at the hospital yesterday.
the guy who rammed into me got the only ticket issued for the accident and has
admitted that he was on his cell phone when it happened.... this really sucks.
i just hope i can possibly get a new car out of all of this. i don't want to have to
keep a mangled mini fixed back to "working" condition. we'll see......
at least this time around i will be able to order a MINI with all the options i want, if that becomes a option! i guess i could live with a pepper white S......

Unfortunately, the most important thing to do is act promptly--at precisely a time in your life that I'm sure you'd rather sleep and forget. Getting checked out in a hospital, retaining duplicates of EVERYTHING for your personal files (receipts, med records, time off, etc.) is important and will certainly help speed along a settlement (as if "speed" and "settlement" actually belong in the same sentence...) but if you happen to miss/forget something that's also what your lawyer is for so try not to be toooooo stressed.
Sometimes insurance companies settle quickly... sometimes not. So, not to be the harbinger of negativity, just be prepared for a kind of long process. Better to be prepared for a bit of tedium and welcome the surprise of a quick/easy process.

Not wanting to fall into the lawsuit world so I let my insurance handle it at the beginning. Well to make a long story short after two surgeries, a month out of work and still being in pain five years later I got screwed by the insurance company, I did get a lawyer towards the end but it did not help much.
The lawyer stated that if I had come to him first he would have been able to do more, I hate to say this but you need a really good lawyer.

I recommend that you write a detailed statement of what you saw and experienced as soon as you can. Your account of what happened will change with each passing day and such a statement will be very helpful down the road.
I was rear-ended by a guy who had the same insurance as me (State Farm). This turned out to be great for me because they waived ALL of my deductibles since they would have to had pay them through my claim against him. I hope you have a similair experience.

Nfo, glad to hear you are doing better. I have been thru a similar experience on a then 1 year old Acura Integra back in 1996. Been there done that and let me tell you, is not fun at all. I had a perfectly nice looking car with 12K miles semi-destroyed with hefty front frame damage. An idiot in a F-150 pickup ran a red light (He himself crashed against a concrete light pole after hitting me) and hit me front/sideways. My car looked like a spoon.
I was wondering if you can post pictures of your car. Many of us would like to see how the car held up during what appears to be a pretty severe crash.

my digital camera a nikon coolpix 4500 was damaged in the crash....another bummer!
