It was the State that screwed up if anyone did. They should have come to the IA prepared to argue for pre-trial detention, i.e. NO Bond, if they saw this as a dangerous crime that needed to have the community protected from the Defendant at all costs. Considering his relative lack of any priors they probably didn't see it that way. Conservative law and order types ( not saying C4 is one, but...??) are always railing on against "judicial activism" Without a Motion for his pre-trial detention without bond that is exactly what C4 is proposing, that this judge should have excercised his power outside of the existing law and detained this man.
Generalizations about judges and other legal practitioners are rampant in our society, and not very flattering either. We may be the most highly scrutinized profession there is. Most of our business is conducted in an open forum with everything being permanently recorded. How many other professions could benefit from that spotlight? Certainly most of our corporate entities don't welcome that. How about you car salesmen out there, do you want your sales negotiations recorded for all to examine? I doubt it.
Hindsight is always 20/20, I am sure even this man's family would like to see him now alive behind bars. But we have agreed to live under the rule of law. Innocent until proven guilty and being allowed bail until proven different or admitted guilt are substantive rights and cornerstones of our criminal justice system. Remember other countries do it differently, guilty until YOU prove your innocence, and stuck in a squalid cell for months or years at a time without any relief in sight. We only reserve those conditions at the moment for "enemy combatants."
I hear China & N. Korea don't have much of a criminal problem, but I don't believe any of us would like to live under their forms of govt.
