The passenger window on my 2009 clubman is not closing correctely. when it is put all the way up the window goes infront of the window gasket that is at the front top corner by the winshield. if i push on that corner a bit when closing the door i can get it in the gasket. anyway to adjust this

First,

Check to make sure the gasket is pressed all the way in place. The rubber gasket should be pushed all the way in and in to the crevice between the A pillar cover and the body seam. You gasket might be out a little forcing the window up. Make sure the seal is even all the way around first.

You can see in this pic of the MINI Clubman up near the front of the window and what it should set like with the seal.

Second the alignment of the window is a little bit of work. It can be finely adjusted.

I mentioned how to align and if its straight and not too high, its likely the seal.

If your window is straight on the seam with the B - pillar, then you can get a new seal. IF not then you can adjust it with a tool. A MINI dealership or anyone with the ability to align panels can do.

For adjustment
*There are two mounts on the bottom of the window at the meeting of the regulator to the glass , they look like little gears and take a special MINI window tool. * Looking at the window on the side of you MINI with the door closed = in essence you can move the window left, right, up , and down by a small amount. But not toward on inward to the car. * Unless you are able to do some mechanical I would leave this to someone who can repair windows.
