R50/53 nooooooooooo car accident... but there's a twist
my 04 cooper S... i've had for less than 2 months... just got in an accident...
but here's the kicker... the one who was driving was my friend... but... my feelings for her surpass that of friendship which makes it really hard for me to accept her offer to pay...
aside from how i feel... i know she needs that money to go to new york for school...
ahhhhh
well either way, what i need is a whole new rear bumper and paint job just to the left of the driver side taillight...
everyone who's seen is has been givin me high quotes so i figure i might as just use the money for the aero kit...
i'll put up a pic soon, what do u guys think?

i honestly can't say who's at fault... cause to me, from what it looked like, it was both their faults so for now, i agreed with the other person that we wouldn't go through insurance cause when i thought about it, in the end, i would get screwed

what color do you have, MC or MCS, you might be able to find the rear bumper cover from someone who has put on an aero kit, depending on the other damage, it make cut the cost alot.... I have a silver bumper cover, ill sellit ot ya cheap if it the right color.....

You could look at it like this... if you don't use the insurance you're pretty much getting screwed because you pay them for specifically this reason. If you pay for the insurance but DON'T use it, then you're just throwing out whatever you pay in yearly premiums.
If she's at fault your insurance will just go after her insurance for it.

I would at least have your friend pay the deductible.
a friends a friend. If i wrecked my friend's car, I would fix it completely
plus pay for his/her loaner during the repairs and give a couple hundred
dollars extra for him/her to spend during the grief.

You posted so I am assuming you want to know what people think. I don't have all the answers, but am willing to offer my perspective.
I would do what I had to do to make my friends car right if I were to wreck it. I do not like to drive other people’s vehicles if I can avoid it. Has your girl friend offered to pay or even help pay? If not, then consider getting another girl friend.
She was responsible for the safe keeping of your car. She failed. If she offers no help, not that you have to take it, then she doesn't understand responsibility. This doesn't look good for long term partnership. She has got to try to hold up her end of the log.

I do not want the stress on a friendship of wrecking their car. I do not want to have a friend feel guilty about not having money to pay for damage. I don't want feel bad about asking a cash lacking friend to pony and pay. Don't put yourself in this position again.
What is the cost estimate to get your car fixed? What are you paying in insurance premiums? If you make a claim and your insurance goes up, or are cancelled, can you get other insurance? Evaluate the insurance options. If cost is low enough fix it yourself, but if you start getting into thousands of dollars then look at making a claim.

You're better off using your insurance, unless your friend has other accidents on her record over the past 3 years. If she might be at fault, and you don't want to add to problems with her driving record, that's up to you. Otherwise, her fault shouldn't affect the cost of your insurance premiums, which are based on *your* driving record. Even if you think that your premium might go up, keep in mind that you'll probably pay more for repairs than you would in increased premiums over the next 3 years. Accidents more than 3 years past are (from what I understand) not supposed to affect your insurance rate.

check with your dealer, or some dealer in the general area and see if they've ever put an aero kit on a yellow Cooper S. If so, they will likely still have the rear bumper cover lying around the shop somewhere and may be willing to sell it to you cheap...they might even install it for you.
If you still need paint on the fender, then you can look at getting that part repaired on your own.
