Dealership Problems.

Well we should have stayed in Boston.. Our local dealer MINI of the Mainline in Bala Cynwyd, PA owed us a part, "The Chrome Pedals" we have gone 3 time cause they said the part were in but get there and then they open the box and its the wrong part. So they called Friday while we were heading for Boston, and we decide to go when we got back. So today we went and guess what, they ordered to brake pedals? And none of the managers would talk to us. But that is not the worse part, Thanks to Mini of the Mainline we have a crashed up piece of metal. The service guy decided to fill the tank to make up the wrong part and got hit.. Now we have a loaner.... Stay away from this Dealership, sevice is horrible and we are changing to another.

Thats a tough break. maybe next time you are up the Boston way you should stoop at Mini of Boston or Mini of Peabody to get your parts. Cal ahead and they will have them for you and i have never had them get a wrong part in. And Mini of Boston has Sunday hours for service. Yes that is correct you can get your car serviced on a Sunday.

Hope all turns out well with your car. Make sure that they to an awesome job on the repair before you accept it.

Hey There, Sorry about your loss. Did your airbags deploy. Are the buying back the car or just repairing it. If airbags deployed it really drops resale value of car. It maybe in your best intrest to speak to a attorney.
Good luck.

Where was this service guy filling up your car's tank that allowed it to be hit and by what?! That sounds very strange...was it at a public gas station??? That looks like quite an impact to me. Can you give us some more background on this? First impressions are that it sounds as though something out of the ordinary was going on.

We have a lawyer in the background when he is needed, but for know we are waiting for the Police Report. As of now the 1st adjuster is at 11,000 without close detail or lifting the car. We have one more today. The steering wheel airbag did deploy but I am not sure why none of the other did? It was hit on the passanger side front so you would think the passanger side dash would have or even the driverside windwhield colum? We don't plan on taking that car back, and the dealership is fully aware of that, but everything is politics.

We have not gotten the Police report yet, but from talking with the Officer the witnesses claimed the Service guy was driving fast and making quick turns. There was a girl in a Lexus making a left on green and the guy was making a left into the station. I will know the exact details when we get the reports. Something is not right but we have to wait for things to play out. But we do have a loaner, Cooper S.

Well that's even worse than I expected. I am very upset for you. Appreciate your giving more background info and glad to hear it sounds as though you are covering all your bases. Please keep us informed. I really hope that things get dealt with properly and in a timely manner.

If no one was sitting on the passenger side, then those airbags wouldn't have deployed.

+1

Otto's has been great in all aspects of sales and service. Back when I was shopping for my first MINI, MINI Mainline gave me that cold 'we don't give a #@%* feeling' I wouldn't dream of using them.

**up-Date**
Sorry it has been so long but as you can guess, no really changes. The car was accessed by 2 insurance companys. Both claimed as totaled. We still have the loaner at no charge and shooting to return it with 15,000 on mile gage. We got it at 6450 and are a t 7829 as of last night, not bad for a couple weeks. We planned some very long roadtrips.. Look out Key West.

Ok, Car 1 Our MINI & Car 2 Not Our MINI posted speed 25. As far as the Police report it states Car 2 was in the left lane with indicator on going west on Montg. approaching Old Lancaster Rd. She stopped for passing traffic and the light turned yellow, once opposing traffic stopped she went. She stated as she was half way through a yellow car came out of nowhere. Car 1 was traveling east in the curb lane as he approached the intersection, he claimed the light was green so he proceeded through. He claimed as he was going through the intersection car 2 turned left into his lane and he was unable to avoid striking car 2. Witness was in the curb lane traveling east on Montg. Ave approaching the intersection and the light turned amber so she slowed down to stop. There was nobody in front of her as she approached. Before she got to the light and yellow car cut her off from the left lane at a high rate of speed and she had to slam on her brakes to avoid stiking them. The yellow car went throught the intersection as the light was turning red and Car 2 was already most of the way through the turn. Yellow Mini hit Car 2.

Damage report, car 1 disabling front damage, Car 2 disabling pass. side quarter panel. Both taken for minor injuries. Car 1 recieved two citaions, 1 careless driving 2 failure to obey traffic control devices. Officers opinion car 1 was at fault. Dealership said car 2 gave a statement at the hospital that it was her fault, of coure that is nowhere to be found. Still no word of a replacement from the dealership, not even a phone call other then they dilibertaing still?

Wow.

I am really hoping that Car 2's driver has no lasting health problems.

This is a story for the record books. Glad you have that loaner and thanks for taking the time to update us. Hope you'll get what you want when you want it. I'm babbling because I'm really speechless.

Wow it right.

If it was mine and the dealership had not responded in ONE week my lawyer would have been all over them as to where my new car was at. It sounds to me like the dealership is at fault as it was one of there service people that was responsible for the car. And in my view of this he should not have even been off the property with the car in the first place. He was not doing a repair that required a road test.

I would demand a much better car than what you ordered as they have screwed around much longer than they should have already.

Have you called Mini USA to make a complaint because if you have not you surely should.

Looks like your car is already for sale on eBay !

None of your posts indicated you had settled with the insurance company.

First, my sincerest sympathies to MiniBean in this mess. I would be totally beside myself.

And, normally I would sit back and watch this unfold. However, I must comment because that is definitely MiniBean's car on ebay.

The ebay seller is "Thompson Motors, Springtown, PA. ...a damaged vehicle liquidator in Eastern Pennsylvania, located one hour north of Philadelphia." They say that they purchased the car from an insurance company, and that "the vehicle is sold as-is and we do not have info. on what happened to the vehicle."

So somehow that car has made it to a salvage yard an hour away from the dealership, and they own the title!? And MiniBean doesn't know about any of this?? Wow! MiniBean...did you sign over the title to anyone?

Unless MiniBean has already paid off the car loan, the bank owns the car and holds the title.

Minibean...
First - I'm so sorry to hear what happened. That's just awful.
I was telling my dad your story, because I thought it was so terrible... and he brought up a good point.

You need to get a lawyer. (And this from a man who HATES dealing with lawyers.) If the people in the other car were hurt - then they will probably sue, and because you were the registered owner at the time of the crash - your name would end up on the suit. It can be a sticky situation... but a lawyer would help you make sure that if a suit is filed, you are not liable.

Also - this is probably one time to make sure your insurance company is informed and educated on what happened. I was in an accident once, where a Beemer ran a red light, but I was turning left. Had 4 witnesses see the accident and saw the guy speed around others to run the red light, and totalled both our cars. My insurance paid 40,000 to the guy for the crash, as I was trying to fight it. So the guy got a new Beemer on my dime, and I got higher insurance rates. Make sure they know you want to fight against it, and the dealer should be liable, if the other driver calls them to settle this. Many times the insurer will just go ahead and settle it - then it's on your record with the insurance company. A lawyer can help you with this also.

Anyway - I wish you well... and if you get to order a new MINI... then tell the dealer you want some latitude (free) with options (on them) for your time.

Good luck!

Being familiar with the intersection in question, I found the description of the accident pretty interesting. If you put "montgomery ave & levering mill road bala cynwyd" into google maps, you can see the intersection in question (streetview is great - if you look towards the traffic light, it is as if you are the person making the left). What you will notice is that there is that, if you are heading East on Montgomery, before you get to the intersection, the road curves to the left, meaning that you can't see more than 100 yards in front of you, and a person making a left can only see about 100 yards.

Left Hand Turn cases are tough, because it is a he-said-she-said sort of thing (light was green, no the light was yellow). But anyone who drives around that intersection knows you have to slow down there because of left turns and limited visibility, and you would think the service people would be more careful with your car.

I would definitely get a straight answer out of the dealership on Monday as to what they are going to do to replace your car. If you can't get an answer on Monday, you need to have an attorney fax them a letter on Tuesday to wake them up. I expect that their initial position is going to be your insurance value plus the first open slot they get. Hopefully an attorney can help them move to full replacement.

Sadly, this is the dealership I am getting my Mini delivered to. I am going to tell them not to let that guy drive my car.

What a nightmare. I would def get a lawyer and agressively pursue ensuring that the injured party only pursued the dealers insurance and that the dealer gets my new car to me right away. Your car is totalled so the dealer needs to addess its responsibility and replace it. Definately don't leave it up to them. I would also seek to ensure that the driver is an ex-employee. No room for that kind of stupidity in the service business.
Best wishes for a good resolution.
John

Publishing the names of bad dealers matters.
Their staff visits thes sites and likely has members speaking nicely of that particular dealership.
Don't back down.
Contact MINIUSA with complaints and blog about bad dealers.
