R55 Dealership Problems.
The dealer now has nothing to do or say.. That is why they have insurance.. It is all in the hands of the insurance companies.... Just call your insuance company and put them in contact w the dealers insurance company and drive 2 company also... Start building your new mini and start searching dealers for it.... you may have to keep the loaner car until yours arrives the dealer you pick... Very simple issue.. this happens all the time..The dealer has nothing to do with replacing it, their insurance does or yours does....stay calm

Beyond the terms and conditions of the policy the insurance company will do nothing.
Pressuring the dealer to do the "right thing" and expedite the replacement of the vehicle the dealer destroyed is not likely in the policy.
I've seen how some of those kids hired to wash, detail, and deliver cars at the dealer drive, it's nuts, I'm surprised that this doesn't happen more often. Hope it all works out for everyone involved, the other car was a victim too.
[FONT=Calibri][SIZE=3]As of now we have not paid anything, the car has been deemed totaled we have had 2 different free loaners from the dealership. First was a full loaded 08 cooper S, we managed to put about 5000 miles on in a month, and the 2nd is a semi loaded 07 cooper S with 2800 miles but after a little more than 2 weeks it has about 4600. That should help the resale since it is off their used car lot. But the dealership has finally order a replacement but you can no longer order 2008 clubman’s, so it’s a 2009. Another problem is they do not offer the sports package until Dec. so the dealership is paying to have this installed for us now. We are still fighting because you do not get the same for the money with the 09 since the start price is already $1000 more than last yr. and most things the price has gone up. We will probably order from another dealer and let this dealer order one for the fun of it and not sign the papers. That’s it for now, just putting on the mile..[/SIZE][/FONT]

OMG!! That is so incredibly shady from so many different angles! Looks like the totaled Clubman didn't meet the reserve price and has been relisted:

Mini Bean 2, I am so sorry that you have had to endure all of this! The dealership should definitely order an exact replacement to your dearly departed car and just eat the difference in the interest of their PR reputation, if not out of downright common decency!
Just out of curiosity (and you don't have to answer), is your insurance covering the cost of the new car, or is the dime coming from the shady dealership?
Enjoy the last fleeting weeks of summer! I would definitely agree (and do the same) by racking some really good miles up on their car. I love taking long road trips!

Don't blame you for wanting to stick it to them - but maybe for your karma's sake you'd better not - when it comes to actually taking delivery from them.

You are wise to stay on top of this and not "assume" that all parties involved have your best interests at heart.
It is NOT "run of the mill", since your car was damaged while in the dealer's custody.
They should get you as close to identical replacement as possible, for hte same money - no doubt there. Buy it from them, since you have leverage with them, service it elsewhere. Any other dealer would definitely understand the circumstances, and happily service your car.

Yeah... I don't think that's a good idea. However, maybe you should put an ad on ebay with a the exact same picture of your car and the story behind it. Sell a 2008 Clubman keychain or something. That way, when someone searches for a 2008 Clubman, they'll get a link to your Clubman story.
Or, how about trying to get EBay to pull the auction. Tell them the guy doesn't have the right to sell the car since it's still in your name.

Rise above...while it's easy for us to offer advice, since this horrible thing has not happened to US and OUR car...take advantage of our arm's length filtering...

Wow..I just read this entire thread and am surprised at MOM....I have many friends who have bought from them and have no problems with service or anything. Accidents do happen, that's part of life....it's the recovery process that matters and it doesn't sound like either the dealer or insurance co is handling this correctly.
I bought my cars from Morristown MINI and Prestige. I would highly suggest Morristown..they are awesome. Best of luck to you...hopefully I'll see you around sometime since we live so close to one another!

Well I called everyone and here is the story, As of today we still have ownership of the car until the loan is paid in full. That should be in a couple weeks. Geico said they sold the car to this Salvage yard to resale "AS IS", but they will not have a title until our loan is paid off. So he can't really sell the car. What I have thought is to throw a wrench in the gear and report it stolen since the car is still is our name? So he would be selling stolen property...
DO start an eBay auction for a 2008 Clubman item and include details about the incident but do NOT include a link to the other auction--you can't even mention the other auction because eBay will pull your auction.
You could include tips about making sure a seller holds the title, etc. etc.
