The JCW does not come standard with the JCW body kit. You can get it with the standard MCS body kit, the factory aero body kit which this car has or the JCW body kit.
Looks exactly like a JCW that I drove today. And loved. Compared to my 08 MCS, it was:

Externally, the rims are the tell tale sign its a JCW. Then the jCW badge on the back. I don't think the dealer installed JCW kit comes with a rear badge.
It is a 2009 factory JCW car with the factory aero kit-not the JCW aero kit (the Canadian JCW factory cars have the factory aero kit come on them as standard equiptment)...Hope that helps!

what's up w/its front grills? Upper & lower. It doesn't look like mesh, rather slots/slats. ? Or slats infront of the mesh? Is that part of the factory aero kit? (if so, i obviously had never noticed)

the jcw aero kit, which is optional, is different from the *regular* aero kit. this one has the regular aero kit
The regular aero kit it standard on the JCW in Canada, and the JCW aero kit isn't even an option, suprisingly. I'm sure you could order it separately, but it cannot be ordered installed from the factory.
That's certainly true, + a few other minor touches. I think you're of the age to have done this... Remember the effort put into determining if a car was a real the Chevelle SS or GTO? I recall so in the late 70's. Many a fake did we see. With even less effort someone can very easily make their S a JCW clone. There being nothing in the engine compartment and only that little checkerboard sticker on the right of the dash in the interior... That'll become more of an issue in years to come when many an "S" becomes a "JCW" from the outside [rims, two badges, 1 pair of skuttles] and inside [1 sticker], oh, and exhaust tip is notably unique in not having a stamp.
I have a 2009 JCW and that sure looks like the one I have except I opted for the Sport Stripes. My only option was Sprt Suspension. I did not want the add on JCW body kit. I like the clean look much better. Mine has a Germen made engine as well as a Germen made transmission. It is Fast & Fun. I see this one has the color matched wheel trim etc. I have the black wheel trim and the back of mine is different. Go to my Gallery for photo's

How did you figure that? I'm not understanding how you guys know it's a factory JCW just by looking at the front bumper?
I bought my MCSa off the showroom floor. It had JCW front brakes and JCW wheels on it.
I added the JCW stage I kit and JCW springs and bodykit but the wheels were on it. (which incidently I had them taken off... I'm not paying 4200 for rims on a mini cooper)
Just curious how you guys know it's a factory JCW.
