Design flaw, coverup under the hood OR ??

GP'ers. I noticed the back right edge (looking from the front) of that trim around the intake had two major worn spots. The right side is MUCH worse than the left side. I asked my dealer and the SA noticed above this area on the bottom of the air scoop how it appears there was some creative shaving in two spots (but not enough). It's eaither that or it just wore down OR?? Has anyone else seen this on their GP? My SA is going to check with MINI and another local GP owner. My GP has it as well. I have a lot more grinding/shaving going on.

Not sure on the First pic.. but the second one is to allow the longer or wider depending on how you want to look at it.. Intercooler. The directions that come with the GTT intercooler (which is what i have) inform you to make the same type of mod to the scoop or deflector. I'm Pretty sure since the GP was a Limited Production they just Modded the parts they already had instead of retooling new ones.
