Ok thank you I sent the service manager at The Mini of Allentown a e-mail to see if it all works out under the 4 year warranty. Hopefully all i will have to pay for is the oil change I need. Thanks for the input guys, i will keep everyone posted on what happens, and what the problem was.

well its in the shop now( since 9:40). They said that the fluid was at the correct level and there was no metal in the fluid. They called Mini to ask for help cause i guess this isn't a common issue. I was told that the Mini has a "learning" transmission and that something could have went wrong with that. They reseted it and were going to take it out a few times to see if that corrects the issue. If not then they may need to put a new transmission in it. Sorry if this doesn't make any sense. Its been a few hours since they called me and I may have mis quoted them. He did say everything will be covered by the warranty.

just got a call from MINI, looks like the transmission is getting replaced. Won't be done till Monday or Tuesday of next week. So, I wonder what went wrong that a transmission had to be replaced with under 40,000 miles on it. At least the warranty will be covering it.

You may have just had a transmission that was flawed a bit.. The problem was most likely in the valve body. But dealerships don't mess with that type of thing. they just replace the whole unit. Good for you though! Now you will have a new transmission free of charge!

ya hopefully its all free of charge haha. Maybe they will be nice and do the oil change for free since I'll be without a car for another 4 days. A man can dream.

the repair report didn't go into much detail. Just stated that it was a defective transmission, and that there were no codes or pending codes and the fluid had no metal, no bad smell, or discolor and was at the correct level. Also I guess there is a recall. My sun visors got replaced. Kind of a strange recall. Bill came to $87 and change for the oil change. Thank god for that warranty. Hope this tranny lasts longer then 38,500.
