Now, saying that they are made by someone other than MINI is quite fair; many of the parts on the car are made by someone other than MINI. But that doesn't mean they are aftermarket. At a minimum, they meet MINI's specifications for fit, finish, function, and quality. Aftermarket parts might not, though they may also be of equal or better quality than the OEM parts. But it's a bit of a crapshoot.
as for a body shop, as long as it's licensed by the state that's all that matters. you do not lose a warranty because of body work not done at a dealership (not that they do any body work themselves, it's usually sent out). the only time you might have an issue with warranty on a car is if there is a problem that can be traced back to the accident which was not fixed at the time of initial repair. in that case, the dealership will not cover the repair but will expect the repair shop and insurance to cover it. this would be true no matter who did the work, even the dealership. warranties are for covering issues where there is a problem from the factory, it does not and will not cover problems due to your car accident.
from the pictures it seems as if it's really just cosmetic damage, so it should be easily fixable. FYI - not sure where around the city you are located, but ray catena does deliver and i believe so does gotham mini. parts should not be that difficult to get, as there are actually quite a number of mini dealers in the area.
I'll disagree with you guys all day long. A battery in your MINI made by, let's say Everlast for example, is an aftermarket part. It's not a MINI part. If they replace your battery after delivery, you going to ask for an OEM battery ? There is no such thing.
I consider OEM to mean anything I can order from the dealer with a BMW/MINI part number.
I consider OEM equivalent to be anything that was made by the same company that made the OEM part, but purchased through alternate channels with alternate labeling.
Example: Bosch makes the battery for my BMW X3. I can order it from BMW and it'll have a BMW sticker slapped on it, or I can order it from Batteries Plus and it'll have a Duracell sticker slapped on it.

I look at it the way I do because when I went to Claim Rep school (8 years ago), they taught us that any part not made by the car manufacturer is not considered OEM. And if our estimators replace a part they mark it as an aftermarket part even it it's identical to the part they removed that was original, if it was not made by the manufacturer. But hey... won't debate anymore and hijack the thread.

The problem now is getting all parts. There are few Mini dealers around NYC, however, not every dealer delivers.

Have them do all that before taking delivery. It will expedite any adjustments to the original estimate and eliminate and undue delay in the process.
