After searching I have not come across anyone else with this situation and would like to hear the collective opinions of the communty.
I purchased a Mini that was CPO Certified, however the BMW dealer never processed the paperwork for CPO coverage.
The dealer where the car was purchased is going to offer an extended warranty in lieu of the CPO coverage the should have had. The mileage of the car currently is well within the CPO coverage.
My question is what are my options? I am not really interested in an aftermarket warranty. How do you value the benefit of a CPO coverage plan? Last, hypothically is the purchase contract of a CPO car which never had CPO coverage still valid?
Do I have a leg to stand on by offering/threatning to return the car which was purchased as a CPO Cerfitied but the paperwork was never completed by the dealer?

Is the CPO, the deal where Mini provides a bumper to bumper warranty for the car up to 100K miles? I bought a 100K extended warranty once for my Land Rover and paid 3.5K for it. Mini's should be less, as they cost less. But seems to me they need to do something. Any reason they can no longer offer CPO? I tend to think the manufacture vs. aftermarket plans are best, usually they are less likely to go out of business or use aftermarket parts.
It seems to me that if the paperwork says you bought a CPO car, you have two strong legs to stand on. It's not often that a dealer gets stuck with their own contract, but this seems to me one of those times. I would let the dealer know that you don't care what happened at their end with respect to the paperwork but since your contract says you bought a CPO car, you expect all the coverage and benefits of a CPO and then have them confirm that in writing. You paid for that coverage because CPO cars are more expensive than non-CPO cars.
The contract is void if they did not comply with it. Assuming you can prove the original contract specified CPO, it would be an easy case to win.
Personally I would not accept the dealer's written word that they (and they alone) would honor the original contract. Nor would I accept a third party warranty. The CPO is a factory warranty that will be honored by any dealer any where.
You are entitled to what you paid for or your money back.

If your paperwork says you bought a CPO car then you deserve the benefits of the CPO warranty. If the dealer made a mistake and didn't submit paperwork, thats their problem. If it was me, I would be telling them that if you wanted an after market warrenty you wouldn't have paid the premium price for a CPO car. And if they don't want to cover the car "in writing" with all the benefits of a CPO warrenty, let them know you will have to obtain legal help to get what you have coming. Heck, you might want to call one of your local news stations and see if you can get them to help you. Does the dealer want the bad press of selling cars as CPO and keeping the profit and not purchasing the CPO warranty from the manufacturer??

In a way, seems like you have a case for "fraud". It would seem you have a leg to stand on to give the car back and get your money back. Then what would they do? CPO it again and resell it?

CPO Coverage
I'm bumping this thread because I'm in a similar situation.
We purchased our 2013 Mini from a dealership with 3K miles on it. It was not originally listed as a CPO car but we negotiated to pay $500 over thier asking price as long as they would give the car the CPO coverage and they agreed to this.
At closing on the car the only paperwork they provided to us related to the CPO coverage was on a printout of the Vehicle Data sheet.
On this date sheet it listed the CPO 72MO/100K MLS as Pending and not Active as the original new car warranty and maintenance plan were.
When I questioned the dealership on the "pending" status and concern we had nothing to show actual coverage the service manager signed the Vehicle Data sheet as a record of the dealership standing behind the CPO coveage.
A month latter I called the dealership to get the CPO contract number and proof that the CPO coverage was "active" and was told that I would be recieving this in the mail but that it usually takes up to six weeks for us to get it in the mail.
It's been six weeks and we've heard or recieved nothing.
We were also supposed to recieve a survey to fill out on the dealership and have not recieved this yet either.
Should we be concerned that our CPO coverage may not have beed activated?
Is there any way for us to confirm that we do indeed have this coverage?

Don't accept anything less then the CPO coverage. An aftermarket warranty will never be as good IMO.

Actually, it was a year and seven months old...but your point is still valid. Keep after them...
From what ive seen a vehicle that is still under full factory warranty and has cpo it will show pending on the dcs. Cpo wont go into effect until the vehicle goes out of factory warranty. its Mini's way to track warranty dollars spent. If ya have it in writing then I think your are good.

Checked back with the dealership one month after purchase and the CPO coverage was still showing as "pending".

After two more weeks and hearing nothing back from the dealership, I e-mailed the salesperson iquireing about the "pending" status of our Minis' CPO coverage.
Just recieved call from the dealeships salesperson and was told that the data sheet on our Mini now shows the CPO coverage as "active" and that she the salesperson) will send us a copy of that data sheet.
Issue resoved, but one has to wonder whether the CPO coverage would have been processed from pending to active staus if I hadn't kept on them to complete the processing of the CPO coverage to the active staus.

The salesperson eventually managed to get my Minis' CPO coverage to show "active" as opposed to "pending". The salesperson told me that this CPO coverage would now stay with the Mini Cooper for the full remainder of the CPO warranty period which is an additional 2 years &/or 50K miles whichever came first. That would be a total of 6 years &/or 100K miles with the factory and CPO combined.
The salesperson told me that where ever the Mini went (sale,trade etc.) this coverage would go with it and not need to be transfered to the new owner.
You would think that MINIUSA could provide a link to where I could simply pull up a record showing that I have this coverage, but they didn't and refered me back to the salesperson and that sales person is going to send me a data sheet that will show the CPO coverage as "active".
I believe thats all I'm going to get and surely it should be enough?
