The lady that struck you, she has insurance right? Did you get a police report?

Man that is one hard hit ! Call your Doc if you haven't already.

Personally, I will celebrate the day when GPS's in phones stifle texting abiltiy when motion is detected at ground level.........no text could ever THAT important at risk of life and limb.

Did LE check her phone ?

She had insurance and admitted it was her fault. As for checking her phone I had my Autistic kid in the back seat who didn't understand what was going on and was screaming cause he wanted to go home, so the LEO gave me an case number and sent me on my way. I'll know more tomorrow when I get the incident report.

In Texas, the offense would either be following too closely or failure to control speed. Most rear end collisions are the fault of the driver in the rear. Hope you get your precious Clubbie back into perfect condition. What I see is bad is that the impact looks like it bypassed your bumper and is concentrated on the doors. Not good at all!

Yeah what I'm afraid of is the way it push the doors in may have bowed out the rear pillars.

Demand that the woman's insurance company make your Clubbie like new again. Sign nothing until you are "made whole" again. If you are feeling any pain or discomfort, get it checked out ASAP. It'll do you no good, if you wait. Make sure the officer included the other driver's statement of guilt in the report. If it is illegal to text and drive, or use a cellphone and drive in your state, you might want to see about subpoenaing her cell phone records.

So sorry man. At least she admitted fault. The #1 rule is to never admit fault, so since she doesn't know any better I say she needs to learn a valuable lesson. This is my #1 fear, living in the age of texting and driving. I'm glad nobody got seriously hurt.

I am glade you and your child were not seriously hurt, but have a doctor check the both of you out. That brings back painful memories of my accident this past november. Take the advice of trwxxa in post #11, do not sign anything her insurance company sends to you, hire a good lawyer.

c'mon man! How do you not admit fault in a situation like this? I know what you're trying to say, but this one seems pretty clear-cut to me. Anyone with half a conscience would own up to that Like a previous poster mentioned, it's almost always the fault of the following vehicle.

BTW, glad you and your kid are ok

Glad you are OK or seem to be, both of you.

Best to watch yourself well. I had a high speed rear ender about 5 years
ago after the terrible headache subsided (about a week) it turned out I had
a torn disk which took me years to recover to maybe 75 percent. I knew I was hurt but certainly not that bad until a month later I got refered for an MRI.

Well it seems as though the car is repairable my insurance adjuster thinks I may have been lucky she missed the bumper cause if she had hit it probably would have bent the frame as well as damaging the doors. Now comes the diminished value part
