personally, i like the red with white backups. clear taillights are on the scion XB...and every other civic on the road. the red and white are more subtle.

actually the whites are turn signals. I like the all clear on a light colored car but there not legal without some red reflectors. But some nice LEDs would be sick in those clear ones, for all around ease and no hassles the red and white ones would be best.
Ah, I'm so torn. Those taillights are hot, jfunk. I want to take my "Cooper" badging off the back, too. And was I thinking of getting those LED bulbs. But then with the white, I have to worry about my car not being legal. I was thinking the red might look more... mature? Or something? But, ah, the white on all black makes the car look so amazing. I already have the white 3rd brake light, and that looks great. Does anyone know how MINI handled the issue of the red reflectors when you could order the car with the white tailights already installed?

As fas as factory/dealership fitment. They get you by the short hairs. They install red reflectors in the bumper shell. They charge big $$ for it and for the assembly installs. I did it myself in 10 minutes. I have no red on the back of my car, which is technically speaking not legal, but I haven't been pulled over once for it here in AZ.
It is also way easy to get the OEM ones to fit a 05+ model unlike what MINI says. No wiring needed, just need to remove a bulb inside of them.
And yes to the poster who asked, these were offered through the 04 model year from MINI. Mine were purchased form Aaron at outmotoring.com. in fact it was my write up he quotes in the website listing as to how to install them!

As far as legal goes. Most states require a "red refelctor to be visible from the back of the car". but as I said I haven't had any issues. I know many other people who have done the same thing and don't have issues.
The change for the 05 facelift is why these aren't offered for the newer cars. All you need to do though to make them fit is this: Buy the lights from outmotoring or wherever. The bulbs in the OEM units are soldered in. Don't ask me why. You need to remove the top ornage bulb and replace it with a clear one. Just use your soldering gun to melt it all off, wiggle the bulb out and put a new 1156 clear bulb in. Then plug them directly into the factory harness. They will look like this once installed:
