depends on if they notice....

Bothe the MTH and the Shark let you program back to stock. There are huge discussions about what voids a warrantee. There is also legal thread about what is allowed and what isn't. To get technical, Mini would have to show that your mod contributed to the failure to get out of warrantee coverage.
