I have one on my '05 S, been there since spring 2011. I'm not sure why you're worried about water, it's a closed box and take air from both the stock tube going up front and from the back opening.
I've been running one for a year with zero issues.
The UNI filter sticks out a little bit into the space with the power steering fluid reservoir which concerned me at first because there's the vent above it, but I haven't had any issues with water entering the intake. And I've gone through car washes a lot and driven in the rain a lot.

It's by far the best and most common intake for the R53. Can't recommend it enough as I've used it on all my street cars, race car, and customer cars. We keep them in stock too.

DDM Works makes good stuff, I don't doubt they test their designs extensively. They wouldn't produce a cowl intake without making sure it wouldn't suck up water.
I mean, this could suck in water since it's open to the cowl, but what kind of deluge would you be driving in for that to happen?
