Help!! do I/WE have a Lemon?

I bought my wife a Brand new Mini Cooper S , and it is only 2 months old. The MAJOR PROBLEM is the car goes into the auto safe/limp mode!! ,
( THE CAR STOPS RUNNING ) and this is driving at highway speeds.. Yes I have brought it in for service 2 times , and now it has been at the dealer for it's third (same problem of course) I have read my Hawaii Lemon Law papers and are in the process of getting the paper work ready.
What do you all think?, This problem is Very Unsafe ( life threatening), and now I am notified that they cannot duplicate the problem, but there is NO WAY!! That I especially my WIFE will attempt to drive this vehicle to have this problem happen on these busy roads in Hawaii!
They have reset the computer, and have also changed some sort of valve sensor?? I really don't know, but I would just want My wife to get a new Mini ( equal value ) with no hassle.. Please let me know and Thank you all Popozuda.......

Whenever such a "limp mode" fault occurs, the cars computers will record the reason which can be read out by the dealership - what do they report are they fault codes in the car? Even if they can't duplicate the fault, they can try to fix the fault code.

Just in case you need to persue the Lemon law (hope not..a Mini is a terrible thing to lose)...I would ask them for the Diag readut from thje OBD II sensor...a printed version too. Kragen here even has the electronic fault reader (but it will not print.)

Just for your protection. The worst kind of electronic (or other) problem to figure out are the ones that only occur sometimes. OBD II records the happennings anyway!

ONLY once did I have a problem, that a dealer would not (or could not fix) and that was with a 2004 Audi that had the "new car windshield film that comes from the chemicals in a new vehicle").

It would cloud up the windshield with an oily substance that was almost impossible to wipe off, and it obstructed vision big time!. Happenned whenever it was hot outside and the sun baked in on the dash.

The dealer and Audi corporate got funky with me after a year of complaints (and they could see it happenning...accused me of using an Armor All type product, until I had a sample taken from the dash and analyzed by a chemist...no foreign substance found of course...hey it was a $60,000 auto)...so, I reported the problem to the NTSB and then it hit the fan...The dealer couldn't do enough to placate me...Audi Corporate called me 3-4 times a week too....I sold the vehicle anyway! NEVER would I buy an Audi again because of their stonewalling!

Hopefully your dealership has more scrupples than that Audi one did! (MINIUSA IS ALSO TERRIFIC, SO I WOULD CASUALLY INFORM THEM OF THE PROBLEM)

i've had two minis. my first was a disaster and went into limp mode four times inside of the first few months of owning it. the dealer tried everything. on the fourth limp i simply demanded a new car. period. and that's what i got. i am not at liberty to discuss details as that was part of the agreement in getting me out of that car and into my new (and completley trouble free) second mini, but i would strongly suggest you alert the dealer to how unsafe you feel (i know the feeling!) and demand a new car.
