After reading this thread

Methinks I'll wait patiently until EFR is off warranty, then mod him. I wonder if my dealer would point to my K&N filter (my only "mod") as a source of any future problem?

If the pulley was a 19% reduction or greater I could possibly see the dealer's reasoning, but not 15%.

I just got done talking to the BMW attorney, so now I have two options one is to go with the JCW kit for $6601.00 or $3905.00 which covers Orlando being brought back to factory condition and the purchase of a new super charger.

I asked the attorney why I was being asked to buy a new super charger and he said because the 15% pulley damaged the head. I told him that my super charger was fine and there was no proof of this.

Mini won’t replace the 15% pulley so they want me to pay for a new SC. I told him that they could replace the pulley on my SC, after all that’s how I did it and why should I be asked to pay for something that is not even broken. He surprised me by agreeing with me and said he would look into it and get back with me tomorrow.

Well the price came down which was nice; the $3905.00 is just for the SC replacement that means they are covering the block and the head as well which is good. I can actually see a light at the end of the tunnel.

Will keep you all updated.

God luck with your efforts it seem they are starting to go along.What is your lawyer doing for you though?He should be pushing the issue harder if infact the supercharger didnt cause the problem.If not this will set a precedent for any other Mini going through that Mini Rep and the dealership.Just my thoughts.

Final Orlando Update

Well first off all I would like to say thank you to everyone online for their moral support it did help, my thanks.

In the end the man stuck it to me, my final cost to get Orlando fixed was a whapping $4600.00. Yes that did hurt but there was nothing I could do, I did get the repair cost brought down by $1000.00. They replaced the block free of charge, I had to pay for the new head, super charger, oil cooler, they also found my clutch worn and suggested I replace it while they were there or it would have cost me an add ional $2800.00 down the road.

The reason that they got me in the end was because of the 15% pulley. It turns out the pulley is not California Air Resource Board Approved (CARB) in California. I contacted Moss Mini and asked them if any of my after market arts were CARB Approved and they responded by saying “that's a good question and they would need to check” so they put me on hold, I asked them about the Pulley, Oil Cooler, Intercooler, K & N Filter, and the Plasma Booster. They informed me that the Pulley, intercooler, and oil cooler were not CARB Certified. I asked them why they did not disclose this to me at time I purchase. They could not give me an answer but they would send me to their customer service tech.

(By that afternoon there was a disclosure posted on their web page informing all that the pulley was not CARB Certified)

Well after that, I did my own research and found that the K & N Air Filter was authorized with an EO Number so was the Plasma Booster. But that was it.

So by installing those parts, Orlando now became illegal to drive on the roads of California. The only alternative I had was to bring it back to CARB Certification or factory specifications. Moss motors customer service did call me and apologized for the inconvenience even commented that if it were up to him he would give me a $100.00 gift certificate, but it was not up to him. Well I would like to tell Moss Motors where they could stick their gift certificate and their pulley but I need to keep it clean.

So the moral of this story is always be aware of the laws in your state before you install after market parts. Should you choose to install the aftermarket pulley paint it black before you install it. Maybe then the EVIL BMW NA Rep won’t notice it and you will not have your warranty voided.

Thanks for the final note to bring us full circle! I am sorry to hear that you had to come up with some money because of a technicality! Isn't CA unique when it comes to this issue?

I guess, looking on the bright side of things... You have a new motor again, new clutch, new beginnings???

Orlando is purring like a new born kitten. He wants to vroom vroom, but I need to break him in, so we are taking it kind of slow for now. But once I hit that 1200 mile mark then we can realy go out and play. I put the K & N filter Back on.

I also kept the old super charger with the 15% Pulley on it just in case.

I just read all these posts and was wondering the same thing... Interesting saga. Glad your car is back running. I'll never install a pulley, that's for sure. Where those mods can be fun, they devalue the car, and I do want to sell mine one day (in about 18 months)!

Capital!

I would have had to come up with an additional $3000.00, did not have it.

I would then have lost all my fuel economy and gas is getting to expensive as is, besides I can still have fun.

LOL why spend $3000.00 when you could spend half that and accully get 30 + WHP

The JCW is only 15% flow over stock on the exhaust side only....
