I've read the thread in the stock problems and issues about the squeaking clutch pedal and how from what it seems a majority of the people with this issue had the clutch replaced under warranty. My issue is I have that problem and my car isn't under the mini warranty but I do have a 30 day warranty through carmax still ( did I mention I've only owned this for less than a month) which I've already had them replace a motor mount and the power steering fan.

My concern is they will write this off as nothing wrong common noises etc. Is there a TSB that states this is an issue. Also if I don't get them to pay for this aside from the groaning rubbery sound is there any big concern here? The car drives well and shifts easily. My mini is an 06 mcs with 63k on it.

I think that the problem you are describing is the throw-out bearing.
