Transmission Whine In 4th Gear [06 MCS]

Hello Folks,

I have a 06 Mini Cooper S Manual with 49k miles. It is having the following problem.

In 4th gear under load (acceleration) the transmission makes a whining noise. This noise started ~500 miles after the clutch had been replaced.

Anyone have any insight into this condition?

Check the transmission oil NOW! Don't drive your MINI until you verify there is oil in the tranny. My guess is that the fluid is low. If it is you will kill your transmission in very short order.

You were exactly correct sir. Trans oil was down 30%

I'm hoping that the noise went away for you. Keep a close eye or rather ear on it. Most likely you will be OK. If not the person who did the clutch will be buying you a new transmission....

Not so much.

The noise did not go away, it just got quieter. It's not loud.

I understand your idealistic thought of "retribution", but really there would be very little way to "force them to buy me a transmission". Lets hear it for plausible deniability.

If it was me & they did that to my transmission I'd sure be expecting a fix from them. When they drop a tranny to put a clutch in the front axles are taken out. Transmission oil will leak out of the holes the removed axles left in the tranny. The tech should have replaced the missing oil. He did not, so he has damaged your transmission. You drove 500 miles before hearing the noise. It took that long to do the damage. It was not up to you to check the oil level, it was up to the tech to do that before releasing the car back to you. IMO their fault totally. I'm just a guy on the internet & not a lawyer, but I'd suggest you do consult with one & see with your options are. The cost to replace that transmission will be thousands of dollars. The shop that did the work for you should have insurance that will cover screw ups like this.
