MINI USA is buying back my 2008 MCS!!

If the car is bought back, the title will be branded and the car will be worth much less than market value - much like a salvage title car is. Great buy for that guy in Maine or Alaska, not so much if the next buyer is in the south and gets the hot foot too.

If the car is traded I'm not sure that will happen, but if MINI is no longer involved, it should just be a low mile trade in.

Hope you like the new one better, maybe a week long extended test drive in a loaner first to make sure it's not something endemic to the car?

^^MINIdave I ran into what is called a "snag" today.Having talked with the MINI USA CSR this morning and having all of my additional questions answered including doing a straight trade in and what I have to do in order to accomplish that.He told me:(1) Is to contact the Florida Attorney Generals Office and tell them the 4th repair "fixed" the heat problem and they will remove the Lemon Law on my '08 MCSa so I can then trade it in without problem.(2) MINI USA won't give me a replacement vehicle only because they feel I would complain about the same issue a few months down the road and file another Lemon Law on the replacement vehicle(which is absolutely wrong).(3) Now here is the "snag" when I was at my dealership today working out how I can go about getting into a '09 MCSa they contacted MINI USA so they could get further information in making this a smooth transaction only to be told that MINI USA doesn't want to sell me any MINI Cooper S.I was like huh?

My MA and the Sales Manager have been extremely helpful to me in working with getting me into a new MCSa and I imagine some sort of deal will be made eventually to keep me in a Mini.

So right now I am in a holding pattern until after the Thanksgiving holiday meaning the weekend to early next week sometime until I know which way I will go either with a '09 MCSa or just trade it in for a completely different brand of car and be done with MINI altogether which I honestly prefer not to do.

Wow...Mini USA seems to be playing a bit of hardball...perhaps if they don't want sell you an '09, perhaps it would be better to just continue with lemon law proceedings, get into something else and just be done with it. It truly sux that you have to go through this complex ordeal. Good luck and thanks for the updates!

OOh I was worried about something like that. Do you have an attorney that you can consult with before you sign anything. Sorry to hear about the snag.

Yeah my head is still spinning after all of that happening yesterday.Regarding an attorney I would really hate to got that route but I might end up having no other choice.

Tonight I am having Thanksgiving dinner with my family so I will bring MINI USA's offer of their buy back with me and consult with them first and see what my next option will be.

Wow. Listen, enjoy your Thanksgiving with family today, but do talk to a competent lawyer before deciding what to do next. Talking and getting legal advice is important. I'm not suggesting any law suits, by any means, but you need to know what you're getting into, or out of, legally and financially.

Minor UPDATE

First thank you all and I hope that everyone had a great Thanksgiving!!

Now for the minor update part:
Last night while at my sister's house for Thanksgiving dinner I forgot that my brother-in-law's good friend is a Florida attorney even though I have known his friend for a very long time now.Anyway I brought all of my paper work with me and showed him what MINI USA offer was for a buy back and that they won't offer me a replacement '09 MCSa which I have that option to accept per Florida Lemon Law nor will they now allow me to buy a '09 MCSa even as just a straight trade in if I remove the Lemon Law with the state.His professional advice to me is to now file for a Request For Arbitration with the State of Florida and let the Arbitration Board decide.I also received a contact number from the Florida Bar for an attorney referral that handles Florida Lemon Law in my area with a free consultation.

All I want is a replacement '09 MCSa for my '08 MCSa plain and simple.

Isn't it funny how we universally despise lawyers in general, but when we need them, they come in pretty darn handy? I get so upset reading about some of these seemingly "ridiculous" lawsuits across the country, but both times I got rear-ended by other drivers, just a short letter from my attorney buddy was enough to set the wheels in motion when it looked like I was about to get shafted.

Yes it was.


Although I now have a very strong suspicion that MINI USA has blacklisted me and is not allowing me to own another Mini based on the conversation I had with my MA and the Business Manager on Wednesday.My MA was off today but I will contact him tomorrow (Saturday) to get more information from him.

But honestly I am getting mentally worn out over all of this which should have been a fairly straightforward process.

No not really....when you consider the fact that it's a system entirely designed/ruled BYand for.....other lawyers.

I filed Texas lemon law about my mini over a month ago. The deadline for them to respond was on Nov. 17th and they have yet to respond.

It is now more than 30 days past their required response, so I sent them another letter last week about my disappointment with their response and then restated my issue with the suspension. I also, sent them the letter the state sent me, sent to them and the dealership.

How long did it take mini to respond to your compliant? I've been dealing with my suspenion issue since I purchased my car back in April. I've now got 13,000 miles on my mini.

I remember reading those posted threads but I didn't know what the outcome was which you now stated that you filed a Lemon Law against MINI USA in Texas.I only know the Florida Lemon Law having read the information provided to me which states the manufacturer must respond within 10 calendar days of its receipt of your notification also the notification has to be sent by registered mail with a return receipt request.That way I knew when they got my notice.They received my notification on 11/17/08 and I was called by the MINI USA CSR on 11/19/08 so only 2 days for a reply.

For that much time that has gone by I would suggest contacting the Texas Attorney General that handles the Lemon Law and let them know that you still have not gotten any reponse from MINI USA and see what the next step you need to do.

Anyway best of luck to you as it can sometimes be a very frustrating experience even when we know we are in the right.

UPDATE

Today I did a trade assist at Vista MINI and picked up my replacement 2009 PS/B MCSa and started a new thread in Coupe Talk (2007+).

Thank you everyone for your all of your comments,support and advice.

And no heat issues in my new MCSa whatsoever.

^^U-2 thank you for posting the actually TSB which is very good information for those that still have that specific problem and can let their SA's know that there is a possible fix for it.

Unfortunately that didn't fix the problem on my former '08 MCSa so that was the reason for the trade assist given to me.

If they sold it to someone in Alaska... well, that buyer may appreciate the extra heat!

When I lived in Maine, I tried to start the Lemon Law in '97 with a brand new Jeep I had purchased. The passenger door could not be fixed so that it would sit flush with the rest of the body (4 times). I was told by the dealership after many visits that it was just how it was because it was a "utility vehicle" and actually said, "What do you expect... it's not a Mercedes!" . Took it to an independent garage and was told that the framework of the vehicle was actually twisted but the garage owner would not be a witness for me. (Also the hinges around the windshield started rusting in less than 6 months of owning... starter went... blah blah blah.)

Needless to say, the dealership and management thought I just wasn't happy because I was a GIRL and because it wasn't a CAR... but I loved that Wrangler... SO much fun to drive. I was in college and had finals, I was sick and it was really stressful trying to get anyone to help. I don't remember if I filed for Lemon formally or just gave up... but I ended up "trading it in" which you know how that goes. But the dealership was nice enough to "roll in" the loss for me . I've come a long way since then.

So my point is, YAY for MINI for taking care of this without the torture! And JCR1960 I hope you get what you want.
This is a great post for a lot of reasons. I won't bother you all with a lecture as to why. But people should take note because it gives us so many lessons about life, our emotions, our travails and American cars.

And I suspect this person got an "A" in English 101. Not that this has to do with MINI's, but it's finals time in classes I teach so I am in a grading state of mind.

Sidenote: Isn't it spelled "lookie?"
