D Stock Is the R56 JCW Aero Kit stock class legal???

But, if the SCCA views the port as an extension of the factory, then, call it what you wish, its still port installed, which has been deemed legal according to Doug. I sure hope he is correct in his assessment of the rules. If not, well then, that is the way it goes.

If... the aero kit ends up being legal for stock class, would that mean that those who have 07s without it, can one install the aero kit afterwards and be legal?

As long as you install all of the parts that would have come with the kit had it been installed at the VDC, you should be legal (again, assuming that the kit itself is ruled to be Stock-legal).

Perhaps a better explanation of the SEB's view in general on this kind of stuff is this: While the port facility is considered an extension of the factory, that does not mean that everything installed at the port is legal for Stock class. The practice of allowing certain port-installed parts began with port-installed A/C units (which was how most Japanese cars got A/C installed for many years) and has since been extended to cover certain other parts as Keith and others have pointed out. But AFAIK they have always been approved on an individual basis, and past practice has been that the part or parts in question have to be listed on the window sticker as a factory option, even though they may have been installed at the port facility rather than the factory.

Sometimes items are installed at the port because they are likely to be damaged in the process of coming over on the ship. The aero kit probably falls into that category. And if all of them are done at the VDC, then Mini has better control of quality, etc than if individual dealers did the install.

All that said, the SEB could say yes to your request, but based on past practice I'd say the odds aren't real good.

thanks for the in-depth explanation, that makes sense. I guess all I can do is hope that they approve it. I don't see any down side to having it approved, so, hopefully they will.

BTW, good luck in Huntsville in 7 or so hours, I really wanted to make that one, but, the dealer trade assist is taking way longer than anticipated and the 07 MCS I was going to purchase had something go wrong with the turbo or VVT(had less power than a MC) while I was driving it from the overflow lot to the dealership. It appears that my luck with Mini's is starting to wear thin.

Port installed accessories are listed on a "supplemental" monroney label though - not on the big one that lists stuff from the main factory. That might throw a monkey wrench in to things.
