No gym at your condo? (I don't have one either, but the "fancier" ones do have fitness centers for their residents).

yeah they have a gym here but doesn't have some of the necessaries like a squat rack etc, just a smith machine which can be dangerous to squat/deadlift on

You guys might have a Mike's Express carwash out there... My dad swears by these guys. They don't use brushes and you drive your car through yourself, so there's no risk of them screwing it up...

That said... I don't trust car washes, and even when I lived in an apartment, I found a friend with a house that would let me use their driveway to do it myself.

Well my near by Chevron gas station has a really good laser-touchless car wash so I use them whenever my car is filthy and I have no time for a proper carwash.

Be careful with those high pressure hoses! I'll never use them again. I had a brand new Acura TL that I took the pressure hose to, it tore right through the paint on the plastic bumper section. User beware.

Chomper, hope things turn out OK. What a *******!

I would seriously push for another mini because I personally would not drive your car again. I just think it will always have problems in the future.........

Go for the jugular, there's no excuses for that. Checking the windows should be the first thing they do.

Did water come flooding out when the door was opened?

I seriously dont know how the worker could not have noticed that he left the window down. How far down was the window? Was it just a little down or like half way etc?

I think you are justified in asking for a brand new vehicle. You have nothing to loose here, you might as well try and see what happens.

GET MINI INVOLVED.

My guess is that MINI will NOT WARRANTY anything in your car moving forward. Therefore, MINI would likely help you by supporting the fact that there is NO WAY of making you whole, unless the vehicle is replaced.

This is a WIN-WIN for you AND MINI. They get to sell you a new car, using someone else's money!

I would immediately stop your dealership repairing your mini. You have to at least inquire and see if you can get a new vehicle. As stated, mini might not warranty anything if they know there was a flooding issue.

Hey CHOMPER,

Just curious... I've seen signs at carwashes, more often then not, stating their not responsible for damages. All though your case is gross negligence, do they have such a sign and if so, did they try to hide under it (literally and figuratively ).

Hope you get back in your R56 soon!

Here in Canada, at least, even if one signs away the right to sue for negligence, one cannot sign away the right to sue for gross negligence--in most cases, this usually involves resulting bodily harm, but I'd go for it anyways, and I'd try to get a new car. They should return your MINI to the condition it was before or beyond (including warranty).

Anyways, our local "touchless" wash has a sign like that, but when it tore the antenna off my mom's car (back in like 1999), they did repairs under their insurance policy anyways.

Sorry to hear about it. Having been through 2 floods, (natural variety) cars are never the same - introduces all sorts of gremlins.

For the washing, I just started using a product called Optimum No Rinse. All you need is two gallons of water in a bucket and a couple of cap fulls of this stuff. Works pretty well so far, certainly better than even a 'touchless' car wash. You can do it anywhere.

Optimum No Rinse eh? Hmmmm.... I am intrigued! I love trying new things. I'm gonna Google it as soon as I can pry myself away from NAM. hahahaha

Oh-- and to the OP. I really think you have a solid case for getting a new car; especially if you can get MINI USA behind the idea. It sounds like the water damage was quite extensive. I'm really sorry you had to go through that. Getting the guilty part to admit fault is the most difficult part, and you have already done that! I'm definitely not saying it is okay to take advantage of a situation in a bad way, but-- you're car is obviously never going to be the same. Every time you have an electrical problem, or a squeeky window, or crackling speaker-- you will be wondering if it is because of the water damage. That's no way to live-- and certainly no way to MINI! Best of luck! I am rootin for ya!

I was looking for that powered car wash unit sold by Peter (?) who also sells Black WOW. Came across this thread during my search.

For those who may read this, it's good he got a "confession" since when they have time to reflect people change their stories.

To provide more evidence, take lots of pics with your cell phone camera. Also take a pic of the car in the detail area. (If you did not order detailing services, why was the car in the detail "shop." To cover up their error, of course.

So what happened on this?

I had this happen the day I took a Ford Focus ZX3 home back in 2001, car went through the wash with both Windows open. They did not try and cover up what happened. Funny as it seemed they dried it out everything worked fine. I put 60 k on the car and Traded it back in 2 years later with out 1 Single problem. They did admit fault and gave me a letter stating if there was any issues down the road they would take care of it. They also had a deal set up with the dealers in the area as they did all the detailing for them, so they called and also advised them of the problem. So I was luckly.
