R56 Comfort Access not as Advertised - Do I have a Case?
My advice is just try to appreciate the feature for what it is, and not let your however-justified-misconceptions spoil the whole car purchase for you. Life is short - pick your battles carefullly. This particular battle seems to have a low or even negative potential return for you, all things considered.

does deserve some attention. If the button requires more than one push, that is a defect, and should be fixed.

Instead I have to push this little button on the door handle (which doesn't always work on the first push) before the car unlocks.

Simple cheap solutions from that sh*t disturber, Surfblue!
An umbrella (to keep the rain off you in that lengthy time frame during which you are pushing a button to open the door) and a HideAKey box that they sell at the hardware store... total price tag, twenty bucks, tops! Added bonus: No electronics to fail in either of these low tech devices! Man, do I miss my 62 Mini Cooper!! I want my sliding windows back!

I negleceted to mention my other concern of what happens if you lose or damage the fob. There's that nifty key that slides out of the fob, but it alone will do nothing other than open the door (or raise/lower the windows).
It certainly would be nice to have a nice small flat key that could be hidden, or placed in a wallet that could start the car in the event of an emergency.
Mini has put a lot of faith in their roadside assistance program. My car was delivered without a jack. When I discovered it was intentional, Mini told me I didn't need a jack since I had roadside assistance. I wonder if I can call them this winter and have them swap my street wheels for my winter ones. Or maybe the manual that described the included tool kit was yet another misprint?

He's lucky I let him IN the MINI. No way I'd let him take a drink with him. What do you mean "waiting to happen"??? We have 3 dogs that have no problem drinking (or attempting to) the soda he leaves all over... I recommend the MINI umbrella. But, if you get it, carry bandages with you.

Yes they do make a mess of the glass! Mine will NEVER ride in Isobel.
As far as comfort access goes, so far I feel it has been worth every penny. I love mine. The major selling point for me is just being able to leave the key in my pocket. I'm scatterbrained enough as it is (technician tools in one hand, parts in the other) so not having to fumble around for my keys is worth extra bucks paid. Pushing a button, no big deal.
However, I do agree with the OP. Mini should not be false advertising the option. You had an expectaion and now you are not getting it.
