Automatic Transmission Problem

My automatic transmission was giving me some problems since OXSPEED replaced the shifter. The problem was when the Mini once warmed up would go into neutral in stop and go traffic it was ok on the highway and you didn't know when it would do it making it very dangerous to drive.
So, I took the mini back to OXSPEED back in May to get it repaired since thy had quoted me a decent price to replace the automatic transmission during my first visit. However, it's was now late July (2-months they had the Mini) and the Mini had not been repaired. Since nobody was keeping me informed no one answered the phone and messages were not returned I went up to the shop to find out what was going on. The owner was there and my Mini he told me that his mechanics had quit and no one was available to work on the car. So, very upset with all that had gone on I towing my Mini from OXSPEED.
I did some research and found a shop in Fredericksburg VA that work on high end European cars . I called them and they quoted my a descent price at least better than the dealership and close to what OXSPEED had quoted me to do the work. So, I towed the Mini to the shop in Fredericksburg VA. Well it took 10-days but the Mini is home now with a new automatic transmission (2 Aug 12). It was expensive $5796.00 but the new automatic transmission comes with a 3-year 100,000 mile warranty. If anybody needs a shop to work on their Mini's give me a PM and I will give you the information on the shop.
I purchased a used 2006 Mini Cooper S Conv with 76000 miles on it from a Mini dealership in Virginia 9 months ago. No extended warranty was offered at time of purchase. I am currently experiencing an automatic transmission problem with the Aisin 6-speed with 84,000 miles on the odometer.
My wife had two near miss accidents and I had one near miss, because the automatic transmission wants to go onto neutral shifting 2nd to 3rd gear the engine will go to 4000-5000 RPM and you don’t know when it will happen. When it does happen you get no EML or EPS lights. It will eventually go into gear with a bang. My has wife experienced this while pulling out into the fast lane of highway traffic. I have filed a report with NHTSI, because of the safety nature.
So, the Mini dealership has had the car for the last week on last Friday late in the afternoon the AS called to tell me I need a new transmission and the dealership wanted $9600.00 to fix, I told them that it was too much (since I paid $16000.00 for the car) and would have to lower the repair cost. My last negotiation with the dealership today they came down from $8300, the to $8000, to now $7600.00. This is still too much to pay since I paid $16000.00.
I found a local Mini repair shop that gave me an estimate of $5025.00 to do the transmission repair, which is a factory remanufactured automatic transmission with a warrranty. This shop also told me he had to go with a reman automatic transmission because he can’t get internal parts from the dealership because Mini does not list internal parts in the parts their manuals, Mini wants you to purchase a whole new transmission.

Jason, Rick, Esteban and Scott know Mini’s. And I highly recommend them to do all your maintenance on your Mini Cooper. Oxspeed and their team of highly skilled technicians are the best and there prices beat the dealership inflated prices.
I took my Mini recently, to Oxspeed to have their factory trained technicians diagnoses a problem with my automatic transmission. Their attention to detail and sound troubleshooting skills, quickly found the problem with my automatic transmission that the dealership missed. The problem was with the shifter not the automatic transmission. Oxspeed saved me over $5000.00 dollars in unnecessary repairs. They treat your Mini like it is their own.
I plan to have all my maintenance done at Oxspeed. So if you live in the Baltimore Washington, North Virginia areas bring you Mini to Oxspeed, you won’t be disappointed.

I towed my Mini home I have found a Mini shop in VA that's going to replace the auto trans with a reman. I will be towing it to them on July 21 2012 will take about 10 days the remain auto trans is built to the car VIN#. Will have 36 month 100,000 nationwide warranty. I am disappointed with the way OXSPEED handled my issue, questions PM me.

It probably needs a flush/service, possibly to be reprogrammed/reinitialized. Next step is to sell it while it still works, before it craps out and makes you pay $8K+ for a new one.
nelsi, this problem that Marys 06MINI describes is about a Asin 6speed not a CVT transmission. Probably a different issue.
But I'm curious as to what the actual problem with the false neutral was. There is no way the entire transmission is unusable. I can't stand when dealers and mechanics won't repair the problem and just toss new parts at it. In this case a $9k part at it.
...someone somewhere knows the answer. For now my MINI sits in the garage until the answer comes along...
