R50/53 Reconditioned Parts
Reconditioned Parts
Has anyone IN COLORADO had an accident where you were forced to get reconditioned parts? I was hit by another car and then pushed into the car in front. The at-fault driver's insurance, GEICO, is telling me I have to get reconditioned parts as my parts were old (2002 MINI S.) I am telling them they are old but aren't from someone elses wrecked MINI. Any thoughts or ideas based on Colorado law? My paperwork reads that in Colorado you cannot be forced to accept used parts. I might have to consult an attorney. Thanks!
Unfortunately this is also the law in Florida. If your car is older than 1-2 years, the insurance company will make repairs with reconditioned parts.
Just another successful ploy of insurance companies to save money on claims and not be forced to make repairs with brand new OEM parts.

if your paperwork clearly states "you do not have to accept used parts", show it to them and tell them you will accept nothing less than oem and thats it. Let them know you are ready to contact your attourney to make sure you get thengs fixed as they should be. My bet is they will pony up as they should. In Ca you do not have to accept used parts and you can take your car wherever you want and they cant tell you otherwise. They can however make it take longer by continuing to have the inspector come out each time they say they need another part.
