What's the MTH map do to your warranty?

I had v39 previously, to fix the EPA recall. That introduced many problems on what had been a wonderful trouble free car. Until then I was still running v32, the original code that came with the car.

Just got back from the dealer. v41 did nothing for the off throttle herky-jerky show.
When I questioned one of the BMW/MINI techs about what v41 was supposed to correct he was not sure, but did tell me that v41 was for both BMWs and MINIs.
I am going to try and contact the SM, I was lead to believe that he would know if anyone would.
The start-up from a dead stop seems better, I will do more testing. I am pretty sure that the dealer reset the adaptive programing as all of the readouts of the OBC were zeroed out.
Tomorrow morning we'll see about the cold start and hard start problem.

I have been running MTH maps since October of last year..
when the car was re flashed with v41. the flat spot appeared..
when I remapped the mth.. the problem went away.. had a very lovely track day today!!
btw, for those with v39+ have any issues with the original
stumble-off-the-line problem from years back?
Mine is a pre v34 (it's got a 06/03 birthdate) and other than the
"stumble" it drive perfectly fine. Im planning to take the car in for
an oil change this year and I think the dealer is going to make me
reflash the ECU for the recall.
The car doesn't stumble unless I enage the clutch
while the rev is a tad higher from a stop...so hasn't really been
an issue for me...I seldom experience it. if the dealer forces me
to update to v41, what should I expect in terms of performance?
it's sounding like the performance is going to degrade...

How can you tell the version?
How can you tell which version of software you have. I had my car into the dealer last week for key reprogramming. They said they do not flash the car every time because you can only flash an ECU about 9 times then you need a new ecu. Why should I care it's under warranty!! Can you get the version to come up on the screen on the tach?
