You haven't mentioned the type of transmission, nor the age of the car, nor the type of the car.
The only case where such a message might NOT be an instant warranty issue is as follows:
1. the car is NOT a Cooper S, nor a JCW Hardtop
2. the car has the 7 speed DCT transmission, not the 8 speed Aisin reserved for the higher-output models
3. the car is 5+ years old
Due to aging of the clutch plates in the DCT transmission there is an AGE based threshold in addition to the mileage threshold of 100,000 miles.
So Dealer Warranty unless all of the above apply.
