I bought my 2006 R50 here in Israel about a year ago and, had I known then what I know now about CVTs, I'd probably looked for a newer model.
But I just found this about the class action suit: "The case is specifically about the CVT automatic transmissions, which in the early days of MINI, accounted for less than 50% of US sales and even less in the European market."
Now I'm wondering, How can I tell if I definitely have a CVT?

If you have an auto gen1 cooper r50...(not sure about the MINI ONE)...YOU HAVE A CVT.
CLASS ACTION cover cars sold by miniusa...sold in the us...pretty sure exported cars are excluded....so 99% sure you are out of luck.

Is there any info on the actual failure rate?
I'm not losing sleep over it but it is in the back of my mind every time I perceive/imagine a change in engine noise or acceleration.
In the meantime, I don't regret my purchase for a minute.

It seems folks who do regular fluid changes and drive "gently" with minimal bumper to bumper stop and go do best....a few reports of folks going over 100,000 miles..including a moderator here...but when I bought my S, ordered in July 2004 (for a 2005 model year...wait times were once 6+ months) my local dealer was aware of the cvt issue then...and "gently" suggested folks wanting a auto get the (then) newly available auto s that started in 2005......so the fact they kept selling a product with an issue...then did not Extented the warrenty like Nissan did on their CVT trannys made folks mad....
Hard numbers...who knows...many of the cars are just parted out...spending $6500 on a car worth less than that running is a no go for most...even when newer..some did it...just to sell the car to limit losses with a used tranny from a wreck making it "good enough" to trade sell.
