Just bought 08 MCS and rear tailgate will not lock when opened with the remote. Also when it does lock the front diagnostic panel indicates it is OPEN. Just bought from BMW dealer w/warranty will get them to look at. Any experience with this problem?

Sounds like a microswitch issue on the hatchback.
If warrantied, bring it in and have them assess and fix it.

BMW dealer fixed the problem. There are ***** on each side of the tailgate hatch. They were loose and just about had unscrewed completely out. Once tightened tailgate now closes and the hatch open sensor shows closed.

 

mine does the same thing. you have to press and hold the trunk release button on the remote again for you to be able to shut it and have it lock.

 

I had both of those happen to mine. First it rattled and the dealer adjusted the latch. Then those bolts got loose due to insufficient torque. Later I had the issue with it not always resetting after unlatching with the remote. The dealer replaced the latch mechanism under warranty.
