Busted For Topless Motoring
Well it had to happen sooner or later.
My driving habits would get me pulled over.
On Thursday (12/27/07) I was stopped on my way home from a run to the local supermarket.
It was a nice clear evening just a touch below freezing, and our little village was lit up for Christmas. Before leaving the parking lot I decided to put the top down and take a leisurely drive down thought the center of town and enjoy the view.
About halfway down the main drag a police car lights up and I pulled over.
The officer walked up to my car and said “Do you know why I stopped you?”
I replied, “Let me think for a moment. When I left the parking lot I stopped at the traffic light with my turn signal on. I stopped for the second light. I am not using my cell phone. My seat belt is on. I was driving 25 in a 30 zone. I don’t have any lights out. My radio was off. All of my window stickers are current. Sorry, I don’t have a clue as to why you stopped me.”
The officer then asked “Have you been drinking this evening?”
I replied that I never drink.
He asked for the standard paper work and called in my plate number.
When he returned he said “Isn’t it too cold to have your top down.” I said “That’s you opinion.”
The officer then told me the reason I was stopped was because I had my top down and he felt I was trying to sober up on the way home.
I told him that I would be happy to blow a 0.0 in his meter and he then gave me back my paperwork and told me to drive carefully.

It's a cute story, I know when I pull a "I feel like fresh air" windows down sunroof open I'll draw a tad more scrutiny. Simple fact it it's one of the tells of a drunk, and unless there was traffic, 5 under factor in speed error and you're doing about 22 in a 30, another indicator of possibly being DUI as some folks slow to compensate for the delayed reaction.
Sobering fact is this time of year many folks make poor choices, and it does take lives,be glad he was looking out for yours, and make sure you bundle up next time.
i got pulled over once for suspected dui, really glad i hadnt drank anything at all. the cop asks me for my license and ins. its freaking freezing out so when i hend him my license i drop it. he then makes me get out and do stupid human tricks and calls me in to the "desk sergeant", he then asks if my friend can drive my car and i tell him NO. he then asks ME to drive the car into the parking lot about 5ft away and i almost lost it, about a 1/2 hour later when we get done at the station i ask him why he had me drive my car if he thought i was drunk, his response and this youll love i didnt think youd been drinking WTF, why the trip to the station and everything aahh
Some police can be bullies! Seems like the ACLU would like to hear about getting pulled over simply because you chose to drop the top in winter. UUGH!

"irratic behavior" is generally reasonable grounds for a stop. Whether driving top down when it's 10 degrees is irratic is subject to inperpretation, but I bet the cop is safe on the stop.

I used to occasionally drop the top on my 124 Spider during the winter. Some people like dry winter air.

That's a funny story. Seems like something a drunk would do in very cold weather... Also seems like something a MINI owner would do too. I'm not saying all MINI owners are drunks nor all drunks are MINI owners. You can you draw your own conlusion on that one.
Driving top down (I don't want to tease anyone again

The only times I will keep the lid closed is in the rain and snow.
Driving topless in the winter has drawn many comments from folks that thought I had lost my mind. For example, I confirmed a fellow motorer's supervisor suspicion that "all MINI owners are insane". Insane no. We drive cars that are fun and not something that is so boring that it numbs your brain.
I look at it this way, First and most important I would not want to violate my motoring agreement and be reported to the motoring police ( 1-888-DO NOT CLOSE). Second going lid-less was an expensive option and I want to use it. After all the individuals that comment aren't making the payments.
