A wonderful image for sure, but people get all weird up here too about taking children's pictures. I think that you did the right thing in not pushing it, but they have to be real about their location and accessibility. A very artful shot lady. Take more (but watch the kids)!

This is the question I've always asked myself when making a decision on whether or not to get a release...can you identify the subject as a unique person or property (i.e. movie star, etc)?

If you can't, it is likely you don't need a release, but there are shades of grey on this issue. However, unless people are clearly and unambiguously identifiable in a way that a judge in a court of law or an arbitrator in a dispute would be able to say, "yes, that is that person," you do not need a release.

In all cases, if unsure, get a release. But in my humble opinion, Stoopid Girl had the right to take the photo, post the photo in this forum and could "probably" sell the photo. I don't think there's a judge in the country that could positively identify the person in her photo.

Subject plainly visible from sidewalk? No reasonable expectation of privacy.

Hahahahahaha...I did think about that, but I'm too nice some times. That's ok I'm going to watermark the photo and leave it in their mailbox with a link to my gallery. I did remove it for the time being because I'm not trying to create bad bussiness. I actually wouldn't mind if they hired me because they're shots I want for myself, it just so happens that they could benefit from them (i.e. the parents wanting photos or using them for a brochure)

Well, I'm not sure they'll hire you if you're going tell them to link to a website called deviantart.com.

I gave them my Flickr link, not the Deviantart link. Flickr is a much better "potfolio" type setting, all though my gallery link still says stoopidgirl.hah hah. Until I get a site up it's all I got. Oh, and I found the ladies' email and just sent it to her but I did put my info on it so they can't use it. Muwah ha ha I let you guys know if anything happens with it.

Ummmm, isn't it illegal for you to open someone's mailbox & put something in it? I may be way off, but I think that's the way it works.

I'm behind you 100% on the whole issue, but I just thought I'd point this out before you give her something bigger & more illegal to screw you over with. Just mail it to her, be safe & more professional... just in case.

That's a beautiful photograph. It's too bad the rider's parents probably won't ever have the chance to see it. I imagine they'd buy it in a second, given the chance, and treasure it for a lot longer than that...

well I did email it to the ranch last night. I'm still waiting to see if they write me back. So no mailbox for me and maybe they'll show the parents...who knows. Maybe something good will happenand I'll get to shoot more picks and possably get paid or maybe nothing at all. Legally I'm fine so those are basically my 2 options. I'm glad so many people agree on this topic.

So I was walking out of the bar tonight and who do you think was walking in?! Amy...the girl who told me not to take that photo. OMFG! What are the odds of that? Unfortunately I had just finished my second beer and was walking entirely to quick to properly process the information. Now all I can do is think "Damnit, why didn't you say something! Argh" ....oh well. I've put to much effort into this thought process already. Time for bed. zzzzzzzzzzzzzzzzzzzzzzzzz

I had a similar experience once. I was on a public street in an industrial park taking pictures of the mountains behind an empty lot. There were for lease signs all over this place. This women comes racing up in her SUV and jumps out an tells me that I can't take pictures. I'm thinking what the hell! I think she worked for the property management, but apparently wasn't fully trained. Some people just have a need act like they have authority.

I know that one. I've been almost kicked out of Walmart and Blockbuster for taking photos because "I could be a spy" from their competition which is the dumbest thing I've ever heard. It's not like the inside of their stores are on their commercials or anything. People are too uptite sometimes.

especially considering the time at walmart when they approached us my friend Justin had a giant stuffed octopus on his head and I was hula-hooping...yeah, sure. We're spies. hahahahahha

Haha, Spys in Disguise. Next time just tell them that you are mystery shoppers from corporate and then pull out your report book and ask their names.

When the woman told me I couldn't take pictures of the lots I was thinking of telling her that I was a property agent for a large company and thanks to her attitude I wouldn't be recommending leasing from them.

well...here's the only update I have for my scenario so far.
NONE...nope, nada, zip. Nothing. They never emailed me back so I'll just keep to the theory that they looked at my photos and were like "Wow, we really screwed the pooch by being snobby to this girl." and that they're too embarressed and snobby to let me know how much I rule. Yup...that's my story and what'll help me sleep at night.
