Hey,
I decided to take a look at my engine air filter because I figured it could use a replacement and I have been looking at this http://new.minimania.com/part/NME451...52-53-COOPER-S
As you will see by the picture I was not far off, it is pretty grimy.
In the meantime, I noticed that the electronics have been cut. why would anyone do this?
And there is also a crack at the mouth of the airbox. Is this a major issue?

Good call on the pod filter, I replaced mine with a K&N a while back and you can feel the increased responsiveness straght away.
As for the cut electrics, it looks like an over zealous air box mod to me. The electronics control the flap that's visable on your second image. The flap opens at around 4k Rpm to allow more air to the motor when needed and provide a quieter sound under these revs.
If you're like me and enjoy the sound of the motor at all rev ranges your better off removing the flap all together. This mod plus the new filter will give you a noticable boost in perfornce.

as to why someone cut the electronics, they were an idiot.
now that you have the thing open, remove the flap completely, and while your at it, remove all the junk inside of the airbox. theres a large canister that controls the flap. its now useless, and just taking up space in your airbox.
there is also another plug in the lower half of the box. it can also be removed for some added air flow. no idea why mini plugged that hole up, but i took mine out when i gutted the air box.
also, try to find the vacuum tube that went to the flap module. chances are, its been removed or taken off. it T connects to the BPV somewhere, and if its just an open tube, you will have a small vac leak, which can cause a yoyo (it did in mine). for almost 2 years it thought my bpv was faulty or crapping out, then i found that hose that went to the flap. folded it and zip tied it off, YOYO went away! i didnt have boost drop in lower rpms at low throttle.
