Gas pedal or tps?

My mini keeps going into limp mode. The dealer says the code is the throttle position sensor. Some people say it could be the gas pedal instead. Any experiences? The car studders under acceleration somewhere around half throttle when the car is cold and then sometimes at random. Any suggestions?

Find the code, and post it...
I have seen leaky intercooler boots do this, and had a failed t-map sensor (hot side...the r53 uses 2, different part numbers) do this too...
The code will narrow it down a bit...

I just repaired a studder that threw a 1688 (bypass valve) four days after repairing a 1498
