Borrow/Rent/Purchase

Situation: Was pulled over last Friday night doing 40MPH, cop asked to see under the hood and bada bing...a fix-it ticket for emissions modification..Now the big problem; referee is needed to correct infraction which will require putting the car back to stock. I do not have the stock boost tubes or stock exhaust from the DP back,which would include the CAT, resonator and muffler. Does any one in the SoCal area have any of these parts in their possession and would be willing to help out a fellow Mini enthusiast? Please let me know, any help will be greatly appreciated. Willing to borrow/rent/purchase, let me know...

I have a stock downpipe, exhaust, and intercooler sitting in my shop. You're welcome to use them for the inspection. I do not have stock intercooler tubes though, as the stock ones are still on my car.

I also have a lift so you can swap all the parts easily if you want to use it...

???....why did you let the cop look under your hood....?

....you should have made him get a warrent.

They could have easily impounded my car, ticketed for no front license plate, tinted windows, and whatever else they wanted. Only a matter of time, I should have done a better job at keeping the OEM parts, the exhaust and DP are very large and cumbersome.

well...no.....despite what some of them may think....police officers have to follow the letter of the law as well.

ticketed you for no plate and tint possibly......but they cant just up and tow your car without reason, now im not up to snuff on CA law, but i dont believe tint and plate are reasons to impound a car......if anything, you risked towing your car by letting them poke under the hood and see your car has been modified outside what CA allows.

if they want to look under your hood, they would need to get a warrent, now maybe having a loud exhaust is enough to warrent that....but that is up to a judge to decide, and they would have to find a judge at 11:00 to issue such warrent.........my guess is that is too much of a hassle for most police to deal with. chances are good you would have gotten off with just a ticket for tint and windows had you stood your ground a little...

police like to bully and intimidate to get around such laws...but laws like these are put in place for YOUR protection....

It appears that in CA they can require you to pop the hood per CA Vehicle Code 2804 (for CHP) or CA Vehicle Code 2806 (all other law enforcement officers).

If CA is like NC, getting a search warrant issued at any time of day is usually no problem.

Probable cause was stated when he said "you are loud"...this gives him the right to look to see if the car is safe or in my case CARB legal. You are correct that it may have gone a different route, by taking a different path, don't/won't know now. I was in an area well known for racing and drifting, that is why they were there. Should have gone in the daytime, but just finished rejetting the methanol injection system and wanted to do a quick test...my idiot self is to

Two250 has so graciously helped me out with the DP and exhaust, need the use or purchase of the OEM cold and hot side boost tubes for the referee....Any help out there? Would truly appreciate it!

California Police officers are allowed to look for "illegal" mods on cars. My cousin is part of the SDPD and was telling me about it because of my car. Of course I did the right thing and ignored him so I am waiting for the day this happens to me.

It happened to me in my Integra about 6 years ago. Got pulled over for loud exhaust by CHP, they made me pop the hood. Luckily every mod had a Carb #. The CHP officer seemed mad that he didn't find anything and gave me a ticket for loud exhaust, which I got dismissed because "it sounded loud" doesn't hold up in court...

Ha, we all have choices and can choose when, what and why, I choose to comply, which in turn yielded a fix-it ticket...wouldn't be that bad if I had all the parts, by not having them has created some issues...thanks to this community, it has been made into a much smaller hurdle to overcome. I believe he was trying to be helpful!

thanks boss....no, im not a lawyer.....but i do know a good bit about the law......however sometimes i forget that CA doesnt hold their citizens in as high regard as the rest of the civilized world.

Then you'd know that warrantless exceptions pertain to all states, and the transient nature of a vehicle often precludes it from warrant requirements.... in all states....

Bump for some OEM boost Tubes? Thinking about a purchase of the CARB legal CAI from NM, place sticker and hopefully the ref closes the engine compartment and does the smog check...have to detach and plug up the Aquamist port, roll up the hose line and hide in battery compartment...
