Check with the company that issued the card first. Charge backs are not automatic simply because you ask for one.

While I wish Mini USA were treating you better, the facts of the matter are that you own a vehicle well out of warranty. Defective or not, Mini has no legal obligation to fix anything that is out of warranty. (The corrosion warranty does not cover your problem BTW. Corrosion warranties cover rust through, not clear coat issues so if the car started showing rust through damage in the next few years you would have a case.) So you have no legal case against Mini other than perhaps going after some kind of "implied warranty" and the legal bar for this is super high. You can sometimes argue implied warranties for products that don't function usefully as the product is is expected to, but for a cosmetic issue this would be extremely difficult. I doubt you could get a lawyer to take such a case without paying their hourly fee which would quickly exceed the cost of the repair.

You can certainly ask for goodwill as you have and you hope they'll look favorably on your case and help out. But when they decline, there is no point in beating your head against the wall - they said no. You express your displeasure with your next car purchase.

I'm sure this is not what you want to hear, but these are the facts of the matter and our sympathy won't change them.

Good luck finding a different rep, MINI reps are few and far between and they cover a large area, be prepared to drive to get out of ones area

Credit cards charge backs will not work like that. That will only fire off an investigation and when the dealership shows that they performed the work, the card will be charged again. In some cases you may also be charged the cost of the investigation.

I agree with Mark on this to be honest. You have a 5 year old car that could have been exposed to anything that might have caused it. How is MINI supposed to know that it wasn't caused by something else? This is not an easy case to be sure...

Any pics of the damage?

Last picture taken of the Mini several months ago before the clear coat started lifting from the car. As soon as the weather clears up later today Ill post pics of the clear coat issues.

I agree I don't think MiniUSA/BMW really care. i called in to the MINIUSA hotline, the lady took my complaint and never heard another word. I sent a email alter and they apologized for my issue with the dealer. I had my wife read the email, not sure what they read but it said no issue with dealer it was with MINIUSA. They sent me a number to call a specific person at MINIUSA. I call no one answers, leave message, they call and I can't answer phone so now playing phone tag with them.
