Laws Getting Tougher In Ca

Just found out today governor Jerry Brown in California has started implementing new smog laws to start in 2013. He set up a new staff that are re-training technicians to spot for any thing not stock on cars and fail them at smog. The technicians get reports cards based on how many they fail. He and his crew are working with automakers to know proper engine and exhaust parts!

That's horrible! I mean, it'll clean up the air a bit, but at what cost!? I feel that as long as our cars can pass smog at the time of the test, then they should be fine.

The Californian Government is stupid.

Who gives a @#$% what's under the hood if it has a cat to filter out the terrible gasses. Guarantee even a HIGHLY modded MINI puts out less CO2 than a Lambo. And Lambos are legal to drive in Cali.... Luckily I live in a state that could give less of a @#$% about your cars.

Time to vote him out or move. Really it makes no sense to me if the car is running clean, maybe even cleaner than stock how can it fail?

You need to educate the powers that be or dump them.

Kaylene and I will be making some of the MINI runs with you soon but I was appointed by Governor Brown as a committee member to start up a totally new vehicle emission program for both techs, shops and consumers etc Gold Shield Sations will go away and new one will be implemented so busy working on this as we have to implement in in 2012 and have it up and running by Jan 2013 Working on specs for Inspectors and Repair Techs at this moment so not much time to go on runs yet as I have to have the pspecs in by end of Jnne and then start specs for tests and re licensing the already licensed tsmog techs 80% of the current techs and shops may not be able to continue working as smog statiosn or shops as we are using a report card basis and if they have not so good a record they will nto be able to re apply for it Dr Dave"

If Dr. Dave is on the committe to set this up, why isn't he pointing out the obvious to them. Making up laws just because they sound good is bad policy, though sanity isn't high amoung many lawmakers.

Hey, I live in California and I'm curious about these new laws. So what you're saying is that Gov. Brown has signed new laws that require smog stations to not pass any vehicle with anything not stock under the hood of cars?

Wow, I'd like to know more about this. Please provide more details, because I did a google search and found nothing. Thanks.

AB 2289 - New Smog Check Law

Set to begin January 01, 2013; Model year 2000 and newer vehicles will no longer require the tailpipe emissions test portion of the smog check process. AB 2289 will require late model vehicles be administered the smog check's visual and functional tests only.

The implementation of AB 2289 is expected to reduce the time and cost of the smog check. The program will now take better advantage of a vehicle's OBD II technology by eliminating tailpipe testing and instead using the vehicle's own OBD II emissions monitoring system.

This new smog test system is already in place in 22 other states. "This new and improved program will have the same result as taking 800,000 old cars off the road, also resulting in a more cost effective program for California motorists." said ARB Chairman, Mary D. Nichols.

Currently California's smog check procedure requires all vehicles undergo a tailpipe emissions inspection to measure harmful pollutant output from the tailpipe, a visual inspection for present and properly installed emissions components, a functional test to insure the proper operation of various emission components; and as part of the functional test, an OBD II computer diagnostic check.

Under AB 2289, the tailpipe emissions portion of the smog inspection will be eliminated for 2000 model and newer cars, trucks, vans, and SUVs.

Background on the OBD II system - All vehicles imported into the United States as of 1996 have had to be equipped with an On Board Diagnostics system referred to as OBD II. The OBD II diagnostic system is designed to monitor all aspects of your engine's emission conditions and report this information to a central database within it's computer. This information is processed and checked against the computers pre-determined values for various input levels and performance patterns.

If any problems are found, the computer will determine whether to alert the driver or not. If a decision has been made to alert the driver of an emissions problem, the "Check Engine" or "Engine Malfunction" light will illuminate on the vehicle's dashboard. In more serious emission conditions the computer may even begin to rapidly flash the "Check Engine/Malfunction" light indicating to the driver, that the vehicle needs immediate diagnosis/repair attention.

AB 2289 now requires the smog test inspection to rely on data from a vehicle's own on board emissions computer to determine the vehicle's harmful emissions production as opposed to using a smog machine to sample the vehicle's emissions output from the tailpipe. This design is expected to reduce the cost of equipment at the smog station, reduce the amount of time it takes to smog check a vehicle, and reduce the cost of the smog inspection to the consumer.

no there is more to come. They are trained to pick out mods under the hood and so they fail the car. Unlike before you could get away with it. They are pressing harder training on the techs for visual. And no that it is going private those ppl want their cut and get paid to fail cars. Makes there grade go up. Waiting for a response back on the final details. Sounds great in theory, but when you get to it their is no grey area anymore just black and white. Mods no mods!

They get paid to fail? WHAT? Thats like paying a cop only when they give tickets. You do that, and everyone they can pull over will get a speeding ticket.

Luckily Arkansas won't have any of these stupid laws, ever. Actually, TBH, I think Cali is the only US state that cares enough about the environment AND has lawmakers that are ignorant enough to pass this stuff. (most states have the later, but the former is much rarer.)

CARB Standards in Other States


Currently, 16 other states have either adopted, or are in the process of adopting, California's strict emissions standards. These states include New York, New Jersey, Massachusetts, Maine, Connecticut, Rhode Island, Pennsylvania, Vermont, New Mexico, Oregon, Washington, Maryland, Florida, and several others. They vary on when they adopted the standards: Connecticut, for example, adopted California emissions in 2004, and the strict regulations will impact cars made in 2008 and beyond. New York agreed to do the same in 2005, and that state requires a reduction in emissions by 2016.

I'm still not sure where this is coming from. The law referenced just says that cars 2000 and newer will be smogged using the on board computer of the car, giving the shop more info sooner. So less time is waisted. I see nothing saying that spotting mods under the hood leads to immediate failure.

Are any of the venders here aware of this? Have they been informed that their products are no longer legal to be used in California? I'd sure like to hear from the guys at Alta, who are regulars here.

It's always been that way. It's the first thing they do when they pop your hood.

The wierd thing about this is, there is really nothing in the Minis "emissions system", that can monitor some of the things they monitor. Like NOX.
