2021 F60 Transmission performance problems

2021 F60 Transmission performance problems

I recently experienced a transmission failure with the following symptoms:
  • Vehicle would only drive when in reverse
  • Vehicle would only advance in 1st gear after an extended cool-down period (overnight), but if the vehicle came to a stop, it would no longer drive in 1st gear
  • Prior to the symptoms, the dash display advised there was a drivetrain malfunction.
The vehicle was brought to the nearest dealership upon being alerted of the drivetrain malfunction.

I have since learned that in August of 2025, Mini communicated to dealerships that the primary transmission oil was on back order, and there was not an approved alternative product. My dash notified me in November that routine transmission service should be scheduled (70,000 miles - the required interval). I completed the dealership transmission service just prior to the 70,000 mile mark.

The above described transmission failure occurred days AFTER the transmission service. I have also learned that the dealership did NOT use the primary transmission oil (DCTF 2-83 22 5 B3A C81), but an alternative oil (contrary to Mini's guidance). The service manager insists the regional rep authorized an alternative oil, contrary to Mini's DCSnet message.

Has anyone else experienced this? How did you resolve it with the dealership? Any advice on how to attempt to make this right with a dealership that insists their regional rep authorized the alternative product? Should I expect the dealership (who arguably assumed liability when they decided to go against Mini's guidance) to compensate me beyond repairs (loss of use, loss in value, etc...)? I'm sure an attorney can help answer that last question, but so far attorneys have stated their billable hours will likely exceed any recoverable benefit and have recommended small claims court to recover compensation the dealership fails to provide.
