cruise control defect

hello everybody, my wife just bought a mini cooper s from 2004 and its got a problem with the cruise control ,it only works in third gear. the indication light says its working all the time. The dealer cannot find the solution to the problem so maybe one of you knows the answer. greetings from the netherlands, europe.

the dealer swapped the boardcomputer for a new one and reset everything still the c.c. is only working in third gear. Now the manual says there is a trans. speed sensor in the gearbox thats working with the c.c. Anyone knows where it is located on the box? Maybe someone knows the partnumber? Thanks.

Mine only works in 3rd gear is as well. I thought it was by design though. Could be wrong, but I think 25mph is the minimum CC will work anyway, so going to 3rd gear at that speed won't be bad for your engine, just down shift to accelerate.
