AEM N18 Intake System Issue

I have an R55 Clubman S with an AEM intake system installed. For the most part, I love this intake system. However, I do have an issue with it... The kit replaces the full air box, and provides an adapter elbow that connects to the factory fresh air intake from the front grill area. The problem I have is that adapter elbow will fall out of the AEM air box, and every time I check the oil, I have to reconnect the elbow to the air box. Has anyone else had this issue with the AEM intake kit?

I don't have the AEM, however couldn't you just remove that factory tube all together and plug that hole and just pull air from the scoop?

The AEM system pulls from both locations. I prefer like that, give much more air inflow. However, when th factory scoop connection falls out, it starts sucking engine air, and I think it’s making my fuel economy take a hit.
