Timing chain engine destruction

my 09 clubman s just died. thought battery died. no other signs, it just shut off and wouldnt start. towed to dealer and was told timing chain blew and destroyed the engine. wont cover any costs. only had it 8 months and it has 57k on it. oil levels were good. now im supposed to cover the $5k for new engine.

This is terrible.
Do you happen to know what other work has been done under warranty? Ask. They'll print something out for you.
My '09 clubman s just had it's timing chain replaced at only 40k and I didn't know until I asked, but it had it already been replaced at 14k as well! When they found that out at my current dealer, they were quick to get corporate involved who ended up taking care of most of the costs for repairs.
Also, you might have heard, there's a current law suit that was just publicly settled concerning N14 motors falling due to the poor timing tensioner, guide rails etc. BMW is paying out 30 million to owners with related cause. As an'09 they'll tell you you're not covered by the new extended 7 year/ 100k mile warranty on the timing chain issue either, however, fight! Tell them this is ridiculous. Ask them what they would do in your shoes.
I'm so sorry to hear this happened to you.
I was close to the same boat about two weeks ago when my timing chain was rattling my guide rails and I took it in.

Wow Clubberman. SO sorry to hear of this. I just bought my 08 R55 about two weeks ago and while I LOVE driving it, I've been on pins and needles the whole time worrying the timing chain or guides were about to go south on me. I FINALLY got it into the dealer this morning and sure enough, the writer says "Yep, that's the sound but not as bad as some I've heard."

Fortunately my car is indeed on the list of covered recall vehicles, so in it went to get this fixed. Of course the dealer is backed up with work, so I'll be without it for who knows how long... could be more than a couple of WEEKS at least! UGH! As long as I can rest and motor on assured my engine isn't about to crater.
