R55 Gear shaped warning signal?

I am still waiting to hear from SA I called no reponse I emailed received one back but didn't answer my question so I emailed him again hoping to hear something from him today. The thing is I am not the only one at this dealership going through the same thing. I am from upstate New York by the way.

My Clubman was fixed for the second time today. So far so good. They said that the actual gear shifter pin was bent which caused the light to go on again. Only time will tell but I'm expecting it will come back on. They said that it probably came from MINI that way. I'm not buying that. And if so, don't you think they would of caught that the first time my car was in for 5 hours?

My main concern with this issue is this: How do we know the replacement parts really fix the problem? I would hate to lose out the car for 3-4 days at the dealer just to have the same gear icon re-appear 3K miles later?
I have had this problem appear from time to time in my Clubman S but I am holding off taking it to the dealer until we know for a fact, that whatever parts they are replacing are indeed fixing the problem.
With MINI I have seen to many instances of replacement a bad part with the same bad part.

Have you read the reports on the thread here: https://www.northamericanmotoring.co...=142643&page=3 - there's a ton of detail... It appears that if it's really fixed, it seems to hold.
Mine goes in on Wednesday - we'll see what happens. Whether it's due to the temperatures being in the 80s vs the 90s and that I haven't driven super long distances...the warning light is not showing. Oy vey!

To me the problem is software related. My amber light comes on once every month or two and goes away. I believe there is an issue but I have my doubts the problem is concentric to the shifter mechanism.
MINI has a tendency to replace defective parts with the same defective parts. Unless part numbers have changed or there is an internal TSB stating that a modification has been made to these components, I doubt this is a real fix. (Just look at the engine noises to see the same pattern of 'shooting in the dark" and changing a gazillion parts just to have the noise come back miles later).
Right now, this is a minor annoyance on an otherwise flawless car with 3,600 miles. But I shall remain skeptical about replacing the shifter with the same part as a permanent fix (Sorry many years of quality assurance testing have tought me a thing or two).
Good luck for the repairs. If the problem doesn't return in 10K-20K miles, then we will know this is a fix. Otherwise it seems to me the problem will return full force just to be back at square one and let MINI begin the guessing game all over again.
